- National Ground Intelligence Center 2055 Boulders Road, Charlottesville, VA 22911 This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. a. Solicitation number is W911W5-17-R-0002, a Request for Proposal (RFP). b. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-95. c. This requirement is an 8(a) small business set-aside competition. The NAICS code and small business size standard for this acquisition are NAICS, 561210 with a size standard of $38.5 Million. d. A list of line item number(s) items, quantities, and units of measure, and options is provided by separate Attachment 1 that provides the proposed contract line item structure. e. Description of requirements for the items to be acquired is provided by separate Attachment 2, Performance Work Statement (PWS). The PWS has 5 separate attachments that are also provided by separate attachments. f. The provision at 52.212-1, Instructions to Offerors -- Commercial, applies to this acquisition. (1) Addenda 52.212-1 (c), Period for acceptance of offers: The offeror agrees to hold the prices in its offer firm for 90 calendar days from the date specified for receipt of offers. (2) Attachment 3 provides an Addenda 52.212-1 Instructions to Offerors. A Mandatory site visit is scheduled for 5 April 2017. Follow instructions to attend the site visit. g. Provision at 52.212-2, Evaluation -- Commercial Items is not used. Attachment 4 provides an Addenda 52.212-2. h. Offerors are to include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications -- Commercial Items, with its offer. Attachment 3 provides instructions for submitting the information. i. The clause at 52.212-4, Contract Terms and Conditions -- Commercial Items, applies to this acquisition. k. The clause at 52.212-5, Contract Terms and Conditions Required To Implement Statutes Or Executive Orders -- Commercial Items, applies to this acquisition. Class Deviation- 2013-O0019, Commercial Item Omnibus Clauses for Acquisitions Using the Standard Procurement System. This clause deviation is effective on Sep 25, 2013, and remains in effect for five years, or until otherwise rescinded. FAR 52.212-5 CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR EXECUTIVE ORDERS--COMMERCIAL ITEMS (DEVIATION 2013-O0019) (JAN 2017) (a) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (a) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract. (2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved. (3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law. (b) (1) Notwithstanding the requirements of any other clause in this contract, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (b)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause- (i) 52.203-13, Contractor Code of Business Ethics and Conduct (Oct 2015) (41 U.S.C. 3509). We recommend you submit your proposal prior to the closing date, allowing enough time to ensure the entire proposal is received on time to be considered for award. If all portions of any e-mail proposal are not received by the closing deadline, the proposal shall be rejected as late (see FAR 52.212-1(3)(ii)). Re-send your e-mail submission if you do not receive a receipt confirmation. If you do not receive a receipt confirmation after the second transmission, contact the Contract Specialist. Due to Government exchange size limitations, we cannot receive individual e-mails that exceed 10 MB, including the e-mail itself plus all attachments. If your electronic proposal, including all attachments, is larger than 10 MB, you shall segment your proposal into a series of two (2) or more separate e-mails that individually are no larger than 10 MB. We cannot receive e-mails if they contain compressed attachments. Our security software blocks these types of e-mails. (2) Offerors shall identify in the e-mail subject line the (proposal number, closing date/time, content, and the Offeror's name). For example: (proposal number, day/time, content, name, location, Message 1 of 5, XYZ Company.") (3) In the body of each e-mail message of the proposal, the Offeror shall provide a brief statement accounting for each e-mail in relation to the entire proposal, e.g., Message 3 of 5, as well as an inventory of attachments, e.g., Attachment 1 of 4. (For example, "This is message 3 of a total of 5 messages constituting the proposal of XYZ Company. This message provides attachments 2 and 3 of a total of 6 attachments to our complete proposal.") (4) Offerors have the alternative to submit proposals using the U. S. Army Aviation and Missile Research Development and Engineering Center (AMRDEC) Safe Access File Exchange (SAFE).
