Department of Veterans Affairs Date: April 14, 2017 From: Foreman Thru: Director, NAD (787/00) Contracts Liaison (787/09) Subj: REVISED "Limited Source Justification and Approval Brand Name Justification and Approval" To: Contracting Officer Centralized Contracting Division (786/41D3A) In accordance with Federal Acquisition Regulation (FAR) Parts 13.106-1(Special Documentation Requirements for Sole Source Acquisitions) and 6.303-2, the following justification is furnished for use of limited source brand name justification: Requesting activity: Department of Veterans Affairs, Culpeper National Cemetery 305 U.S. Ave. Culpeper Va. 22701 Nature and/or description of action being requested: This procurement action is being requested to utilize other than full and open competition for the brand name award to deliver a Caterpillar 305e2 hydraulic Excavator and a Caterpillar 277D Multi Terrain Loader to Culpeper National Cemetery Description of Services: Contractor shall (i) Supply equipment and deliver Excavator and Multi Terrain loader to Culpeper National Cemetery, 305 U.S. Ave Culpeper Va. 22701 Recommended source: Caterpillar Equipment Total estimated value of procurement: $60,675.00 Excavator and $61,599.00 multi terrain loader (See CAATS 8397-000017 and 8397-000018). Statutory Authority: In accordance with FAR Subpart 6.3, and under the authority of 41 U.S.C. 253(c), full and open competition has not been provided based on the following exception: [ X ] 6.302-1 - Only one responsible source and no other supplies or services will satisfy agency requirements. Other Facts Supporting Other Than Full & Open Competition: Culpeper National Cemetery currently has a total of 12 Caterpillar attachment that will work on this equipment including several new attachments we just got in last year that are set up to work on Cat equipment. If the cemetery will go with any other equipment, they would have to retrofit these attachments in order for them to be any use to the Cemetery. The activity heard that some of the CAT attachments will fit other brands. However the activity has also learned that some other manufactures specs read the same but doesn t have the power that the Cat has for the size of the equipment. The cemetery needs max power, at least weight power, because the equipment will be used in a section that weight will be an issue. From previous experience some other brands that match most of the Cat specs don t have enough power when compared to the Cat and a replacement was needed within few years. In addition, all of the employees already learned to operate on Cat equipment. Purchasing Cat equipment is the best value for the Government, as the cemetery already have the necessary attachments and the equipment is much stronger and will last longer, and the employees knows how to operate the Cat equipment. This action will result in the lowest overall cost alternative to meet the needs of NCA. This is a brand name limited source, so there is no limitation on who will submit a quote, rather a limitation on the equipment brand. Listing of Sources, if any, that expressed, in writing, an interest in the acquisition: None. Statement of Actions to remove or overcome any barriers to competition: No further action is recommended at this time.
