Q&A Set 1 DPWS V2 DRFP 19Apr2017 This pre-solicitation notice provides a twentieth amendment to the November 4, 2015 (also amended 1/8/16, 3/2/16, 6/14/16, 8/25/16, 9/1/16, 10/12/16, 10/22/16, 10/22/16, 11/22/16, 12/16/16, 12/19/16, 12/20/16, 1/12/17, 1/19/17, 1/20/17, 2/1/17, 2/10/17, 2/14/17 and 3/01/17). The purpose of this notice is to provide potential parties additional information about the Government's anticipated Reagan Test Site (RTS) Engineering and Technical Services (RETS) acquisition. 1. This release provides updates to Draft RFP (DRFP) and updates to DRFP Attach 01 - RETS PWS (DPWS). 2. Potential offerors have asked whether a system contractor or other original equipment manufacturer (OEM) can compete for and be awarded the RETS contract, which would potentially require the awardee to participate in the test and evaluation of its own products or services and/or the products and services of its competitors (note that it is anticipated that the RETS PWS will encompass the full range of developmental and operational test and evaluation, to include initial operational test and evaluation.) Regarding ATEC Policy Bulletin 2-11 (dated April 19, 2011), neither the U.S. Army Space and Missile Defense Command/Army Forces Strategic Command nor the Army Contracting Command fall under ATEC direction or control and therefore are not subject to ATEC-specific policies, pamphlets or regulations. Further, please note that ATEC Policy Bulletin 2-11 has been rescinded. 3. Per this notice, potential offerors are instructed to assess, for themselves and their potential subcontractors/teaming arrangements, the existence of potential or actual OCI resulting from potential bias, unfair competitive advantage, or impaired objectivity (IAW DRFP Section H.33 dated April 3, 2017). Identified OCI are subject to the restrictions identified below, unless mitigation measures are put in place to adequately avoid, neutralize, or mitigate the potential or actual conflicts of interest. In the event potential or actual OCI does exist, and no mitigation plan is submitted and approved, the following restrictions will apply: a. exclusion from competition for (or award) of any Government contracts as to which, in the course of performance of this contract, the contractor has received advance procurement information before such information has been made generally available to other persons or firms; b. exclusion from competition for (or award) of any Government contract for which the contractor has directly or indirectly contributed to the development of the requirements (e.g., statements of work, specifications, evaluation criteria, or other aspects of a solicitation or contract); and c. exclusion from performing and/or supporting the test and evaluation of products/systems developed by itself (including corporate divisions, business units, and/or subsidiaries), other entities with which the contractor has a significant financial relationship, and/or its competitors. Any mitigation plan for this exclusion must adequately address the restrictions contained within the following references: (i) 10 United States Code (U.S.C.) 2399, and other U.S.C sections which are cross-referenced thereto; (ii) Department of Defense Instruction 5000.02, Enclosure 5 (January 7, 2015); (iii) Army Regulation (AR) 73-1, Test and Evaluation Policy paragraph 5-1; and (iv) applicable decisions of the Government Accountability Office (GAO). Additionally, IAW the updated DRFP Section H.33, and DRFP Section L and M, potential offerors are required to submit an assertion of an actual or perceived OCI along with the required mitigation plan to the Contracting Officer. All offerors are invited to provide these assertions and consequent mitigation plans in advance of the release of the RFP. 4. This notice provides Set One of Industry Questions and Government answers relative to RETS Industry Days, DRFP and its Draft attachments. A second set of Industry Questions and Government answers is forthcoming. The DRFP and DPWS released in this amended notice provide answers to many of Industry's questions. THE PURPOSE OF THIS NOTICE IS SOLELY FOR INFORMATION AND PLANNING PURPOSES - IT DOES NOT CONSTITUTE A REQUEST FOR PROPOSAL (RFP) OR A PROMISE TO ISSUE AN RFP IN THE FUTURE. THE GOVERNMENT DOES NOT INTEND TO AWARD A CONTRACT ON THE BASIS OF ANY RESPONSES RECEIVED. AN RFP IS NOT AVAILABLE AT THIS TIME. REQUESTS FOR A SOLICITATION WILL NOT RECEIVE A RESPONSE. RESPONSES TO THIS NOTICE ARE NOT OFFERS AND CANNOT BE ACCEPTED BY THE GOVERNMENT TO FORM A BINDING CONTRACT. THE GOVERNMENT SHALL NOT REIMBURSE RESPONDENTS FOR INFORMATION SOLICITED. THE INFORMATION PROVIDED HEREIN IS SUBJECT TO CHANGE AND IN NO WAY BINDS THE GOVERNMENT. THE GOVERNMENT RESERVES THE RIGHT TO CONSIDER ACQUISITION STRATEGIES AS DEEMED APPROPRIATE.
