Description
The USDA, SEFTNRL intends to solicit and negotiate with only one source, K&M Electric, Macon, GA. for the installation of lightning protection on the main office building located at 21 Dunbar Rd, Byron GA. The installation of the Lightning Protection System on the main lab building is critical to ensure there is no functional loss of laboratory equipment that would in turn cause loss of research obtained over months and sometimes years. Currently the building is without the benefit of a Lightning Protection System. Over the past 16 months the Byron Facility has been undergoing an HVAC upgrade by McKenzie Construction under contract AG-32SC-C-15-0085. The newly installed HVAC system is 15 feet higher than the previous system and gives a larger opportunity for drawing lightning strikes. The HVAC contract did not contain a requirement for a Lightning Protection System and it was deemed out of scope for consolidation into that contract. Under the HVAC upgrade the Prime contractor utilized only one electrical sub-contractor for the electrical improvements work included in the contract, that sub-contractor is K&M Electric. Under the HVAC contract a one year construction warranty will be in effect by the Prime contractor who performed the work, with that warranty of workmanship rolling down to the sub-contractors. In this situation the HVAC warranty has not begun but will do so in the very near future as the project is finalized. If we were to hire another electrical contractor to perform installation of the Lightning Protection system the work could cause a conflict or overlap in the work performed under the HVAC system. Therefore, by going directly to K&M as the sub-contractor that performed the electrical work under the HVAC contract we would avoid that potential conflict. In addition, by going to K&M Electrical we will maintain the integrity of the electrical work performed under the HVAC contract and the construction warranty for workmanship would be upheld by not only the HVAC prime contractor but also by the sub-contractor performing the installation of the Lightning Protection System. Regardless of a warranty call on the electrical system there will be no question of who to contact for service. This is a contract for services with a projected performance period from May, 2017 through June, 2017. The authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1) or 41 U.S.C. 3304(a)(1) and is implemented by FAR 6.302-1 and being solicited under FAR 13.106-1(b)(1)(i). The Government anticipates the award of a firm fixed price contract for commercial services, and the NAICS Code is 238210 with a size standard of $15 Million. This Notice of Intent is not a request for competitive quotes or proposals. No solicitation documents are available and telephone requests will not be honored. However, if a firm believes it can meet the requirements it must furnish information about its products and services, as well as references from other customers who are using these products and services to the Contracting Officer within fifteen (15) calendar days from the date of publication. Supporting evidence must be furnished in sufficient detail to demonstrate the ability to comply with the requirements. Information must be sent via email to William.Rengstorf@ars.usda.gov. Responses received will be evaluated; however, a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. If no affirmative written responses are received, negotiations will be held with K&M Electric without further notice. This acquisition is being conducted under the Federal Acquisition Streamlining Act, Simplified Acquisition Procedures. The anticipated award date is 5 May, 2017.
