- Subject: Notice of Intent to Sole Source FDA-1182964 Date: April 19, 2017 The U.S. Food & Drug Administration intends to issue a sole-source purchase order to JOEL USA, Inc. for Preventative maintenance service for Jeol JEM 1400 transmission electron microscopy (TEM). The services shall provide unlimited service visits by trained service engineers who are trained and certified by the original manufacturer of the instrument. The engineers shall have access to the manufacturer's latest technical developments, repair procedures, application updates, diagnostic software, and planned maintenance procedures. The service coverage shall include trouble-shooting capabilities based on complete knowledge of the entire instrument, immediate access to certified replacement parts, and immediate access to improvements and new procedures provided by the original vendor and manufacturer. The service shall include two (1) on-site planned maintenance visit per year with all travel, labor, and parts included, to ensure the system is performing to factory specifications. The service visits shall cover microscope performance check, corrective service and replacement of malfunctioning or inoperable components. The contractor shall provide replacement of all components determined by JEOL to be defective without charge. The contractor shall provide unlimited access to application and technology support team for technical assistance at regular business hours (8 am to 5 pm EST). The Service shall include free software updates. The contractor must guarantee that turnaround time from the emergency on-site visit to completion of repairs shall not exceed 72 hours, and turnaround time from a non-emergency on-site visit to completion of repairs shall not exceed 148 hours. Repair work that is not covered by the maintenance/support agreement is not to be initiated by the vendor unless the Government has given the vendor proper authorization. Award will be made in accordance with Federal Acquisition Regulation (FAR) Part 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements using Simplified Acquisition Procedures per FAR Part 13. JOEL USA, Inc is the sole-supplier and only company that is able to provide all of the above requirements. This notice of intent is not a request for competitive quotes. However, all responsible sources may submit a capability statement within five (5) days after the publication of this synopsis which shall be considered by the agency. Responses received after 5 days or without the required information may not be considered. A determination by the Government not to compete as a result of information received is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
