Page 2 of 3 Page 1 of 3 DEPARTMENT OF VETERANS AFFAIRS JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1. Contracting Activity: The agency responsible for this acquisition is: The Department of Veterans Affairs, VISN 17, 2002 Scott Blvd., Temple, TX 76504. The Contracting Officer for this procurement is Lindsey Hooge. The Department of Veteran Affairs proposes to enter into a contract on the basis of other than full and open competition for the VA Medical Center, Amarillo, TX. 2. Nature and/or Description of Action Being Processed: This is a request for other than full and open competition. The proposed action is for emergency continuation of MRI Site Prep project at Amarillo VA. This includes remobilization of an existing job site to include resuming construction from as-is status. As-is is defined as space that has already undergone selective interior and exterior demolition to include removal of a portion of the exterior stucco over concrete block wall system. The majority of internal selective demo has taken place and minor electrical and mechanical tasks have taken place. Work to be completed includes new gypsum wall systems, windows, doors, shielding, mechanical, electrical and low-voltage electrical, plumbing, fire suppression, nurse call, flooring, ceiling, fixed furniture and all associated finishes. This also includes associated exterior wall system for MRI pass through panel wall system. The aforementioned divisions of work are associated with the construction of areas in the MRI zones to include the main MRI area, equipment room, control room and dressing room. Network Contracting Office (NCO) 17 intends to negotiate and award a contract on a sole source basis to Fry Construction Co., Inc. 3212 Commander Drive, Carrolton, TX 75006. 3. Description of Supplies/Services Required to Meet the Agency s Needs: The Engineering Department at the Amarillo VA Medical Center has a request for emergency continuation of MRI Site Prep (Construction) located at Building 28, Clinical Addition. On March 3, 2017 the Engineering Department contacted NCO17 Contracting to request authorization to proceed with an Emergency procurement to resume construction of MRI Site Prep. Authorization was granted on April 5, 2017 and the Contract was executed on April 7, 2017, under the authority of FAR 6.302-1 Unusual and Compelling Urgency. The period of performance was 04/07/2017 10/24/2017. The total value of the action is $598,562.00. 4. Statutory Authority Premitting Other than Full and Open Competition: 41 USC §253(c) (1), as implemented by FAR 6.302.1 ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; (X) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5. Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Fry construction has been providing turn-key site prep construction for MRIs for over 30 years, and was originally contracted by Hitachi, the MRI manufacture, to complete the design and site prep for this MRI. On February 22, 2017 the MRI Site Project was unexpectedly halted by the VA National Acquisition Center (NAC) contracting. A partially demolished jobsite located 15 yards from the main entrance was stopped. Part of the exterior wall section had been removed to allow construction workers to enter and exit the job site that has undergone selective demolition and minor improvements to electrical, structural and HVAC. The current site opening exposes engineering systems of Building 28 (Clinical Addition) to unfavorable environmental elements. The demolished and partially constructed job site presents unnecessary hazards to patients, guests and workers. Fry Construction was a primary participant in site prep design and construction activities, and is in possession of the construction drawings associated with this project. As such Fry Construction Co. is familiar with all work that has taken place and available to re-mobilize immediately to continue construction. Continued delays in completion of construction would result in delays for Veterans requiring MRI services. Furthermore, VA would incur additional costs, to have a contractor other than Fry Construction Co., Inc., complete the MRI Site Prep, because if another contractor were to come in to complete this project a new site prep design would be required for completion, which would take additional time and money. Moreover the building would require shoring up to reduce potential inclement weather damage to the facility; this would increase the cost to the VA for construction. Fry Construction Co., Inc. has the required technicians and the necessary replacement parts required to complete this requirement. 6. Description of Efforts made to ensure that offers are solicited from as many potential sources as deemed practicable: Due to the urgency of this requirement, a synopsis was not posted to FedBizOpps.gov. FAR 5.202 (a) (2) allows exceptions to the requirement of publicizing proposed contract actions due to unusual and compelling urgency circumstances. 7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: In accordance with FAR 13.106-3(a)(2) the Contracting Officer shall determine pricing fair and reasonable based on a comparison to the Independent Government estimate. The requirements of FAR 15.406-2, Certificate of Current Cost or Pricing Data are not applicable to this acquisition. 8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: The services are commercial and sold within the market. Market research was conducted by the using service to determine which contractor was best suited to meet the agency s needs. Fry construction has been providing turn-key site prep construction for MRIs for over 30 years. Fry Construction was originally contracted by Hitachi to complete site prep for the Amarillo MRI. Fry Construction was a primary participant in site prep design and construction activities. Fry Construction is in possession of construction drawing associated with the project, familiar with all work that has taken place and available to mobilize immediately to continue construction. Fry Construction Co., Inc. has the required technicians and the necessary replacement parts required to complete this requirement. Due to the emergency nature of this requirement, the service is only available via the open market. 9. Any Other Facts Supporting the Use of Other than Full and Open Competition: Not Applicable. 10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: There are no other sources but the proposed. 11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: The Government will continue to conduct market research to ascertain if there are changes in the marketplace that would enable future actions to be competed.
