- This Notice of Proposed Contract Action is prepared and posted in accordance with Federal Acquisition Regulation (FAR) 5.201(b)(1) and Defense FAR Supplement (DFARS) 205.205-71. The Defense Microelectronics Activity (DMEA) intends to solicit, negotiate, and award a firm-fixed-price, follow-on contract under the simplified acquisition threshold from a single source, Keysight Technologies, Inc. (900 S Taft Ave, Loveland, CO 80537-6378), as authorized by FAR 13.106-1(b)(1). The CO has determined that the circumstances of the contract action deem only one source reasonably available; market research conducted by technical experts revealed that Keysight Technology's Integrated Circuit Characterization and Analysis Program (IC-CAP) and Advanced Design System (ADS) software is proprietary to Keysight and that Keysight is the only source that sells, licenses, and services this software. Although the proposed contract action will be solicited from a single source, all responsible sources may submit a bid, proposal, or quotation which will be considered by the agency. The proposed contract action will be awarded as a purchase order under FAR Part 12 and DFARS Part 212, Acquisition of Commercial Items, and FAR Part 13 and DFARS Part 213, Simplified Acquisition Procedures. The proposed contract will include a firm-fixed-price contract line item number (CLIN) for the required software maintenance and support agreement. The proposed contract action will have a period of performance of one (1) year; an additional option year may be included in the award. The North American Industrial Classification System (NAICS) Code for the requirement is 511210 for Software Publishers. The small business size standard for the requirement, as defined by the U.S. Small Business Administration, is $38.5 Million annual revenue. Keysight Technologies, Inc. is a large business for the applicable NAICS. In accordance with FAR 6.001(a), procurements awarded using the simplified acquisition procedures of FAR Part 13 are not subject to the competition requirements of FAR Part 6 and the requirement to prepare a written sole source justification in accordance with FAR 6.303 does not apply. As the proposed contract action will be solicited from a single source, a copy of the written solicitation will not be made available on FedBizOpps. A copy of the non-competitive solicitation may be requested from the Contracting Officer, Ms. Nickie Cruthirds, by e-mailing nickie.cruthirds@dmea.osd.mil. The CO intends to solicit, negotiate, and award to Keysight Technologies, Inc. by 12 May 2017.
