- NOTICE OF INTENT TO NEGOTIATE A SOLE-SOURCE CONTRACT The US Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), Eastern Region Acquisition Division, Simplified Acquisition Branch intends to negotiate on a sole source basis with Embross USA, Inc., 63 Westwood Rd, Park City, UT 84089 using the procedures in FAR Part 13, to provide Enhanced Program Support maintenance for the NOAA Kiosk software. The current NOAA Kiosk software consists of 1 license for Kiosk Manager and 70 licenses for Consumer Device Services (CDS). The National Ocean Service (NOS) is a line office of NOAA. The mission of NOS is broad and includes a variety of technical and scientific services in support of coastal ocean natural resource stewardship and navigation support. Within NOS are program offices that are charged with carrying out the NOS mission. The Communications and Education Division (CED) of NOS manages the Ocean Today Kiosk program and produces videos in support of this kiosk program for all of NOAA so they can be accessed at the kiosks located in 32 public locations across the United States Mexico, Canada and the UK. Embross Kiosk Manager and Consumer Device Services are currently being used to maintain content updates throughout this network. CED is responsible for providing updated content displayed on this network of PC workstations. To support this need, Enhanced Program Support maintenance is necessary for the existing Embross Kiosk Manager and 70 CDS client software licenses. This software has the unique capability of managing devices attached to the remote kiosks and managing the sending and receiving of digital files from NOAA to the kiosks in this network. The statutory authority for other than full and open competition is FAR 13.106-1(b)(1)(i), Only one responsible source. This is not a solicitation for competitive quotes. However, if any other interested party believes that it can meet the requirements, it may submit a statement of capabilities, which if timely received, will be considered by NOAA. A statement of capabilities must be received by 11:00 am, May 4, 2017 to be considered by the Government. A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future. Evidence must be provided of ability to provide the required services. The capability statement and any other information furnished must be in writing, and must contain material in sufficient detail to allow NOAA to determine if the party can meet all of the foregoing requirements.
