- Notice Type: Justification and Approval (J&A) J&A Statutory Authority: FAR 6.302-2 - Unusual and Compelling Urgency Contract Award Date: TBD Contract Award Number: TBD Synopsis: The Contractor shall provide all labor, materials and technical expertise to review and revise the Department of Veteran Affairs Medical Center Washington DC S LOTTO ( LOCK OUT TAG OUT) safety program as per current codes Mechanical, Electrical Codes and OSHA Standards. All procedures will be in compliance with Hazardous Energy Control OSHA 1910.147 standards.Contractor shall conduct a field audit of all procedures, policies, deficiencies and update policy as needed. All standard operating procedures will be demonstrated at the convenience the facility. If you find this sole source acquisition not justified please respond to this posting by May 5, 2017 and supply the following via email to Vanessa.Jacobs@va.gov. STATEMENT OF CABABILITY: Submit a brief [ Five (5) pages or less] capability statement explaining your capability to perform services for the DC VAMC. Include past experience in performing these services for the VA, other Government (Federal or State) agency, or for a private medical facility BUSINESS SIZE AND SOCIO-ECONOMIC STATUS: (a) Indicate whether your business is large or small (b) Indicate if your firm is a certified Service-Disabled Veteran Owned Small Business (SDVOSB) or Veteran Owned Small Business (VOSB) (C) Include the DUNS number of your firm. (D) State whether your firm is registered with the System for Award Management (SAM) at www.sam.gov and/or the VetBiz Registry at www.vetbiz.gov. DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) Acquisition Plan Action ID: VHA245-17-AP-3075 Contracting Activity: Department of Veterans Affairs, VISN 05, 688 Medical Center 50 Irving St. North West Washing ton D.C 20422 Nature and/or Description of the Action Being Processed: Requesting sole source procurement to upgrade the facilities LOCK OUT TAG OUT program which supports the Medical Center buildings infrastructure, employee s patients and visitors. This is a facility wide that is critical to the life safety of the facilities employees, patients and visitors therefore these services are needed in order to update this system. The facility presently has a policy and standard operating procedures (SOP S) that are outdated and has been cited by our Hospital leadership for upgrades. We have several new systems that have been added as well as older systems that have to be deleted from the files therefore an urgent and compelling need exist to revise and update this program as per OSHA standards. LOCK OUT TAG OUT programs are extremely critical to a health care facility and Life safety and wellbeing of patient s employees and visitors as well an OSHA and Joint Commission requirement. Description of Supplies/Services Required to Meet the Agency s Needs: Many serious workplace injuries, amputations, and fatalities result from the uncontrolled release of hazardous energy. To curb these accidents, the Occupational Safety and Health Administration (OSHA) issued the Control of Hazardous Energy Standard on September 1, 1989 (29 CFR 1910.147, also known as Lockout/tagout). This standard establishes safety requirements for the control of hazardous energy sources during servicing and/or maintenance. This program refers to machine-specific, step-by-step procedures that must be used for the safe deactivation, lockout, tagout, and testing of facility equipment prior to performing any servicing and/or maintenance. Statutory Authority Permitting Other than Full and Open Competition: ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( XX ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority It is has been determined that a sole source award may be made to Brady Corporation. This contractor has provided services to VISN 5 Health Care Facilities in prior years and is able to support this urgent request in a timely manner. The contracting officer has validated that the contractor is listed in Vendor Information Pages (VIP) data base and qualifies as Approved Vendor in accordance with GSA and Federal Supply Schedule for the applicable North American Industry Classification System (NAICS) code assigned to this procurement. Brady Corporation is the preferred company with technical expertise to preform surveys and updates and installations in this facility. Unusual and Compelling Urgency: The facility has several findings documented by VISN 05 Annual Work place evaluation team during the annual visit in 2016 that the Lock out tag out program for this facility has expired. The recommendation by the VISN Safety Engineers is that the program has to be audited/updated to include the new equipment added since 2010 as well as training for the employee s that come in contact, operate and maintain. This is also documented the Joint Commission standards that requires medical center life safety and utility systems to be maintained/updated as needed at all times. Any fault or spillage of energy and or lack of proper equipment would be a life safety risk for all patients visitors and employees. Delaying awarding this contract could result in serious injury or worse. The medical center would have to stop receiving patients and may have to start emergency procedures to move patients to non-VA facilities which would cost $500k in weekly charges. The contractor has performed prior services and supplied safety services/devices to the VAMC and has been working with FMS staff on other issues. The vendor is already mobilized and has a clear understanding of the requirements needed to provide the services on demand. (See attached document concerning findings for Lock Out Tag Out).. Any Other Facts Supporting the Use of Other than Full and Open Competition: Due to the urgent and compelling nature of the Joint Commission standards that requires medical center life safety and utility systems to be maintained at all time. Any fault or spillage of energy and or lack of proper equipment would put patients at risk while attempting to complete the service in an open market competition.
