Description
Sources Sought Notice for DOE EOC NAICS-236220 Construction of Buildings Department of Energy Emergency Operations Center, Y-12 National Security Complex, Oakridge, TN. A market survey is being conducted to determine if there are a reasonable number of interested small business concerns to set this future project aside for them and also to solicit comments from the construction community addressing the potential use of Project Labor Agreements (PLAs). If your firm is interested in this project (Large Buisiness or Small Business), please respond appropriately. The proposed project is for the Construction of a new Emergency Operations Center (EOC) for the Y-12 National Security Complex, and incidental related work. Please note that this project will be in a secured location and will have stringent security requirements. This facility will house the Plant Shift Superintendent's Office, the Emergency Command Center, the Technical Support Center, and the Fire Department Alarm Room. The facility will be capable of withstanding design basis events and will fully implement existing Emergency Management plans and procedures. The EOC is a single-story building with approximately 11,000 square feet. Special aspects include a solar photovoltaic panel system, Chemical/Biological/Radiological (CBR) Air Filtration System, precast architectural concrete and total building commissioning. The goal will be to construct the building to achieve U.S. Green Building Council's Leadership in Energy & Environmental Design gold certification. The major functions of the building currently exist in several locations throughout the Y-12 site; however, the new EOC will help consolidate all into one building inside the Property Protection Area of the Y-12 site in Oak Ridge, Tennessee. Contract duration is estimated at 719 calendar days. The estimated cost range is between $10 Million and $25 Million. NAICS Code is 236220. All interested Small Businesses, certified HUBZone, 8(a), Service Disabled Veteran Owned Small Businesses (SDVOSB), or Woman Owned Small Businesses (WOSB) contractors should respond to this survey by email no later than 15 May 2017 by 9:00 AM Central Time. A PLA is defined as a pre-hire collective bargaining agreement with one or more labor organizations that establishes the terms and conditions of employment for a specific construction project and is an agreement described in 29 U.S.C. 158(f). Federal Acquisition Regulation (FAR) Policy: (a) Project Labor Agreement (PLA) is a tool that agencies may use to promote economy and efficiency in Federal procurement. Pursuant to Executive Order 13502, agencies are encouraged to consider requiring the use of project labor agreements in connection with large-scale construction projects. (b) An agency may, if appropriate, require that every contractor and subcontractor engaged in construction on the project agree, for that project, to negotiate or become a party to a project labor agreement with one or more labor organizations if the agency decides that the use of project labor agreements will: (1) Advance the Federal Governments interest in achieving economy and efficiency in Federal procurement, producing labor-management stability, and ensuring compliance with laws and regulations governing safety and health, equal employment opportunity, labor and employment standards, and other matters; and (2) Be consistent with law. Reference: Provision: 52.222-33 Notice of Requirement for Project Labor Agreement Clause 52.222-34 Project Labor Agreement. In consideration of the above factors, and any others which may be deemed appropriate, the construction community is invited to comment on the use of PLAs. Of particular interest to the Government are responses to the following questions: Responses should include: 1. Identify if your firm is a Large Business or a Small Business. If Small Business, identify and verify if your company's status is a HUBZone, 8(a), Service Disabled Veteran Owned Small Business (SDVOSB) and/or Woman Owned Small Business (WOSB). 2. Contractor's DUNs Number(s) and CAGE Code(s). 3. Documentation from the firm's bonding company showing current single and aggregate performance and payment bond limits. 4. Descriptions of Experience - Interested construction firms must provide no more than three (3) example projects with either greater than 95 percent completion or projects completed in the past five (5) years where the interested firm served as the prime contractor. Each project must include the name, title, project role, e-mail address, and telephone number of at least one reference. References may be used to verify project size, scope, dollar value, percentages and quality of performance. Example projects must be of similar size and scope. a. Projects similar in scope to this project include: Projects considered similar in scope to this project include LEED Gold certified commercial office buildings or government office buildings that include a solar photovoltaic system and (CBR) Air Filtration System. b. Projects similar in size to this project include: Projects considered similar in size to this project include new construction of building structures in excess of 11,000 square feet. c. Based on the information above, for each project submitted, include: 1. Current percentage of construction complete and the date when it was or will be completed. 2. Scope of the project. 3. Size of the project. 4. The dollar value of the construction contract and whether it was design-bid build or design-build. 5. The percentage of work that was self-performed as project and/or construction management services or physical construction type work. 6. Identify the number of subcontractors by construction trade utilized for each project. 7. Small Businesses are reminded under FAR 52.219-14, Limitations on Subcontracting; they must perform at least 15% of the cost of the contract, not including the cost of materials, with the firm's own employees for general construction-type procurement. Include the percentage of work that will be self performed on this project, and how it will be accomplished. 8. The following questions are related to PLA. a. Should PLAs be executed on selected large dollar contracts within the above referenced location by the Nashville District? What other factors should the Corps consider before deciding to include PLA provisions in a Nashville District contract? What type of project should or should not be considered for PLA? b. Is the use of PLAs effective in achieving economy and efficiency in Federal procurement? What is the estimated relative cost impact, or any other economies or efficiencies derived by the Federal Government, if using PLAs? Will a PLA impact the cost of submitting an offer? c. Is the use of PLAs effective in producing labor-management stability? Have labor disputes or other labor issues contributed to project delays in the local area? d. Is the use of PLAs conducive to ensuring compliance with laws and regulations governing safety and health, equal employment opportunity, labor and employment standards, and other relevant matters? Are there instances where these standards have not been met on Federal contracts in the local area? Were PLAs used for those specific contracts? e. Projects will require multiple construction contractors and/or subcontractors employing workers in multiple crafts or trades. Do you foresee any work on projects that may result in both the prime contractor and at least one subcontractor, or two or more subcontractors, employing the same trade? f. Are there concerns by prime contractors on the availability of skilled construction labor? Information may reference current apprenticeship statistics and workforce age demographics. 9. Any other information/comments about this procurement that you would like to give for consideration. NOTE: Total submittal package shall be no longer than 8 pages.
