Description
The U.S Department of Energy (DOE) intends to issue a contract modification to the Indefinite Delivery Indefinite Quantity maximum ordering amount under contract DE-CF0000185 with Appsential LLC on a sole source basis, in accordance with FAR 6.302-1(a)(2)(ii), Only one responsible source and no other supplies or services will satisfy agency requirements. The increased IDIQ maximum ordering amount will allow for services to continue for the remaining contracted period of performance. The IDIQ contract is currently structured with an inconsistency in two of the current contract clauses relating to the maximum ordering amount. One clause established a "ceiling price" based on the awardee's proposed price. Another clause appropriately establishes the maximum ordering amount at the amount of the final Independent Government Estimate (IGE). Per FAR 16.504 (a)(1) "The contracting officer should establish a reasonable maximum quantity based on market research, trends on recent contracts for similar supplies or services, survey of potential users, or any other rational basis." The DOE Contracting Officer has determined that the maximum ordering amount should be increased to the Independent Government Estimate (IGE) amount. Using the IGE figure as the maximum ordering amount is the most appropriate basis because it takes into account known and projected requirements for the entire period of performance. THIS IS A NOTICE OF INTENT AND NOT A REQUEST FOR COMPETITIVE PROPOSALS. No solicitation is available for this requirement. If a firm believes that DOE should not pursue this maximum ordering value increase with Appsential, LLC. then it should submit a capability statement and pricing information for the requirement by 9:00 a.m. EST on May 17, 2017 via email to Christine.Hopper@hq.doe.gov pursuant to FAR 5.207(c)(16)(ii). A determination by the Government to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
