Description

SOLE SOURCE JUSTIFICATION The U.S. Army Corps of Engineers intends to award a sole source contract to Suburban Propane, L. P. to provide multiple deliveries of propane to the Prompton Dam facility. The proposed performance period shall be for one (1) Base Year of 12 months and four (4) 12 month option years. The Prompton Dam facility requires propane for heating and maintaining project operations. Tanks at the facility were supplied during construction and are owned by Suburban Propane, Honesdale, PA, 570-253-1890. Per Pennsylvania State Regulation cited in Section 5, Suburban must continue as the propane supplier for these tanks. Per Pennsylvania Department of Labor and Industry Regulations, CHAPTER 13. PROPANE AND LIQUEFIED PETROLEUM GAS, Subchapter A. LIQUEFIED PETROLEUM GAS+ 13.8. Transfer of LPG and removal of containers. (a) A person may not transfer, sell, fill, deliver or permit to be delivered any LPG or use an LPG container unless authorized to do so by the owner of the LPG container and authorized by the Department to do so or authorized to do so by emergency response agencies. This notice of intent is NOT a Request for Competitive Proposals. No contract award will be made on the basis of this notice. This notice does not constitute a solicitation document. Requests for such documents will not be considered. However, all information received within three (3) days after date of publication of this notice will be considered SOLELY for the purpose of determining whether to conduct a competitive procurement in the future. A determination by the Government not to open the requirement to competition based upon responses to this notice is solely within the discretion of the Government. The Government will not pay for information received. The NAICS Code is 454310 with a Size Standard of 100 employees.
