- Sources Sought Notice NIST-MML-17-SS-5 posted January 3, 2017 With Draft Statement of Objectives The National Institute of Standards and Technology (NIST) intends to negotiate on a sole source basis, under the authority of FAR 13.106-1(b)(1), with PANalytical, Inc. located at 117 Flanders Road, Westborough, MA 01581 to purchase a Wavelength Dispersive X-Ray Fluorescence Spectrometer System. The sole source justification is based on the following: This procurement is the subject of Sources Sought Notice NIST-MML-17-SS-5 posted at www.fbo.gov on January 3, 2017 a copy of which is attached to this notice. NIST-MML-17-SS-5 contained the attached draft Statement of Objectives (SOO). NIST has continued to evolve its market research since the close of NIST-MML-17-SS-5 and has concluded that only PANalytical, Inc. is capable of providing a system meeting ALL of the specifications set forth in the SOO that pertain to the detector requirements of the system (including, but not limited to item G of the SOO). PANalytical, Inc's unique detector system is a minimum requirement of this acquisition. As such, market research has confirmed that PANalytical, Inc.is the sole company that can provide the spectrometer system that NIST requires. PANalytical, Inc. is therefore the only source reasonably available to provide the required system. The resulting purchase order will be firm fixed-price. The NAICS Code is 334516 with a size standard of 1,000 employees. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested parties who regard themselves as capable of fulfilling these requirements are invited to submit responses to the Government for consideration. Responses received by 11:00 am EST May 18, 2017, will be considered by the Government. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
