- Terms and Conditions J&A Schedule of Pricing PWS This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, Streamlined Procedures for Evaluation and Solicitation for Commercial Items as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; a “Brand Name” fixed price quotation is requested and a written solicitation will not be issued. The solicitation number is NAMA-17-Q-0051 and is issued as a request for quotation (RFQ); quotations furnished are not offers. This request does not commit the Government to pay any costs incurred in the preparation or the submission of this quotation or to contract for supplies or services. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-95 effective January 19, 2017. This is a “Brand Name” requirement in accordance with FAR 6.302-1( c) for “items peculiar to one manufacturer” under NAICS 541519, Other Computer Related Services. The resulting purchase order will be a firm-fixed price purchase order and will be issued to the Contractor whose conforming quotation in response to the RFQ will be most advantageous to the Government. BACKGROUND: The National Archives and Records Administration (NARA) intents to award an Other than Full and Open Competition (Brand Name), one year Purchase Order for NetIQ Primary Support Engineer-U S renewal. REQUIREMENTS: The requirements are outlined in Attachment 1. All delivery costs must be included in the total firm-fixed price quote. NARA requires that all Support Services be acquired from “MicroFocus Resellers Only”. ATTACHMENTS: Attachment 2, MicroFocus Product Schedule of Prices List; Attachment 3 Justification for Other than Full and Open Competition for Brand Name Item. PERIOD OF PERFORMANCE: Annual Buy (May 22, 2017 through May 21, 2018). EVALUATION: Evaluation and purchase order issuance will be in accordance with the procedures of FAR Subpart 13.106, Soliciting Competition, Evaluation of Quotations or Offers, Award and Documentation as authorized by FAR Subpart 13.5, Test Program for Certain Commercial Items. The purchase order will be issued to the contractor whose conforming quotation in response to the RFQ will be most advantageous to the Government. Best value for this competition will be based on a lowest priced technically acceptable evaluation. In order to be determined technically acceptable, all quotation submission requirements must be met including the required documentation submissions outlined herein. The Government reserves the right to issue a purchase order on the initial quote without discussions of this procurement. The following FAR clauses are incorporated and are to remain in full force in any resultant firm-fixed price purchase order, with the exception of FAR provisions which will be removed prior to award: FAR 52.212-1, Instructions to Offerors – Commercial Items (Jan 2017); FAR 52.212-3, Offeror Representations and Certifications – Commercial Items (Jan 2017) – Offerors shall complete only paragraph (b) of this provision if the offeror has completed the annual representation and certifications electronically via https://www.acquisition.gov. If an offeror has not completed the annual representations and certifications electronically at the ORCA website ( https://www.sam.gov ), the offeror shall complete only paragraphs (c) through (o) of this provision; FAR 52.212-4, Contract Terms and Conditions – Commercial Items (Jan 2017) – see Enclosure 4, Additional NARA Terms and Conditions (Addenda to FAR Clause 52.212-4) for addenda to this clause; FAR 52.212 - 5, Contract Terms and Conditions Required to Implement Statues or Executive Orders – Commercial Items (Jan 2017). QUESTIONS: Questions regarding this RFQ must be submitted in writing to Mr. Narciso Cruz (Contract Specialist) at narciso.cruz@nara.gov no later than 12:00 PM ET on May 12, 2017 to be considered. Questions submitted in any other manner will not be answered. The Government will answer questions or requests for clarification via a written RFQ amendment. RFQ CLOSE DATE: Quotations should be received by 12:00 PM ET on May 17, 2017. Failure to submit quotations by the due date may result in rejection of the quotation as untimely. Contractors submitting via e-mail are cautioned that e-mails containing attachments in excess of 25 megabytes (MB) will be rejected by NARA’s e-mail system. Contractors are advised to confirm receipt of quotations. Telephonic responses will not be processed.
