- EVTN Vyopta vAnalytics Maintenance Support Page 1 of 2 JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY Contracting Activity: Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, New Jersey 07724 Description of Action: The proposed action is for a firm-fixed-price delivery order issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V Governmentwide Acquisition Contract (GWAC) for Vyopta software maintenance and support for the Enterprise Video Teleconferencing Network (EVTN) Vyopta vAnalytics application. Description of Supplies or Services: The EVTN infrastructure provides the capability to allow any video device within the VA network architecture to communicate with any other video device. The number of video devices and desktop client users across VA has grown by over 20 percent in the last fiscal year alone, supporting well over one million video sessions. In order to support effective capacity planning and management of Office of Information and Technology resources, EVTN implemented the Vyopta vAnalytics Application to provide effective measurement, capacity planning, and metrics for VA s Video Enterprise Network. The proposed action is for software maintenance and support services to ensure that the Vyopta vAnalytics Application remains fully operational. The required maintenance support package will provide for software updates, technical analysis, problem solving, and diagnostics of the application, as well as routine access to a single point of contact for reporting solution issues. The period of performance for this action is 12 months from June 4, 2017 through June 3, 2018 with one 12-month option period. The total estimated price of the proposed action inclusive of the option period is Statutory Authority: The statutory authority permitting an exception to fair opportunity is 41 U.S.C. 4106(c)(2) as implemented by Federal Acquisition Regulation (FAR) 16.505(b)(2)(i)(B) entitled, Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized. Rationale Supporting Use of Authority Cited Above: The Vyopta vAnalytics Application is currently implemented within VA s existing EVTN to provide for enterprise-wide data analysis for capacity planning and management of the network. Only Vyopta can provide the necessary technical, diagnostics, and operational support necessary to maintain the Vyopta vAnalytics Application and keep it fully operational due to the proprietary nature of the software application. The required support includes all necessary software updates, releases, patches, diagnostics, and custom report updates and builds that can only be issued by Vyopta or an authorized reseller. No other source is capable of accessing the proprietary application in order to provide the required software maintenance support. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. In accordance with FAR 5.301 and 16.505(b)(2)(ii)(D) the resulting contract award will be announced on the Federal Business Opportunities Page and this Justification for an Exception to Fair Opportunity will be made publicly available. In addition, this Justification for an Exception to Fair Opportunity will be posted on the NASA SEWP V website with the solicitation. Actions to Increase Competition: In order to remove or overcome barriers to competition in future acquisitions for this requirement, the Government will continue to perform market research to determine if there are any new products or maintenance services available that will enable future requirements to be competed. Market Research: Market research was conducted in March 2017 by performing web-based research on commercial video support providers such as Cisco, Polycom, Lifesize, and Sony. During this review, the ability to provide the necessary level of technical support was reviewed. It was determined that, other than Vyopta or its authorized resellers, no other available source or device manufacturer can provide the necessary technical support for Vyopta vAnalytics Application due to the proprietary nature of the software application. Based on this market research, the Government s technical experts have determined that only brand name Vyopta maintenance support can meet all of the Government s requirements. Additional market research was conducted in March 2017 by the Contract Specialist by utilizing the Provider Lookup tool on the NASA SEWP V GWAC website. The search identified numerous resellers of the required Vyopta software maintenance and support including 1 verified Service-Disabled Veteran-Owned Small Business (SDVOSB) GWAC holder and 1 verified Veteran-Owned Small Business (VOSB) GWAC holder that are resellers of Vyopta maintenance support. In order to confirm the interest and capability of these two VOSB/SDVOSB resellers, the Technology Acquisition Center issued a sources sought notice on NASA SEWP V on March 31, 2017 to which both GWAC holders responded as being capable of fulfilling the Government s requirement. Therefore, limited competition is anticipated on NASA SEWP V among authorized resellers of the required brand name maintenance support. Other Facts: None
