Description
SOLE SOURCE JUSTIFICATION (Simplified Acquisition Procedures under FAR Part 13 Not Exceeding $150K) 1. Agency/Contracting Activity: MICC, USAWC, Carlisle Barracks 2. Description of Action: Nature: New Requirement Pricing: Firm-Fixed Price Funds: OMA Name of Proposed Contractor(s): Letort View Community Center (LVCC) Street Address: 313 Lovell Avenue City, State, Zip: Carlisle, PA 17013 Phone: 717-245-4049/4352 3. Description of Services or Supplies: This requirement is to provide food and beverages during the AY'17National Security Seminar (NSS) from 4 June to 8 June 2017. The LVCC will provide all personnel and materials for this requirement in accordance with the performance work statement (PWS). 4. Authority: Action using simplified acquisition procedures: FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g. urgency, exclusive licensing agreements, brand name, or industrial mobilization) 5. Reasons for Authority Cited: Per AR 215-1, 8-24.b. Military Clubs. (1) Mission. The mission of military clubs is to - (d) Satisfy market demands of the total Army Family by providing services such as food and beverage, entertainment and recreational activities, check cashing and currency conversion, where applicable and supported. (f) Meet installation mobilization, emergency, protocol, and hosting requirements. (g) Meet the need for command-sponsored events and social function requirements of an installation and its personnel. Per AR 215-1, 8-24.c. FB&E operations. (3) Catering operations. These operations provide catered food and beverages as required on the installation. The mission of catering is to respond to the needs of protocol, hosting, command-sponsored events, the social functions of the installation, and the authorized patrons. Catering is accomplished as follows: (a) The operation will be centralized on an installation and may be located in a stand-alone facility or collocated in another facility such as a community activity center or conference center, or other MWR program. In addition to AR 215-1, because the objective of the AY'17 National Security Seminar (NSS) is to provide a secure location for the "New Members", International Fellows, US Students, staff, and faculty of the USAWC. Use of AHEC, LVCC, Quarters One and the Gettysburg Area Recreation Pavilions are the most effective and efficient locations for the events catering support. Any cost savings which may be realized through full and open competition would be more than offset by additional costs required to move personnel on and off the installation for meals. 6. Actions to Increase Competition: Although actions to increase competition have been considered, none have been identified that are able to ensure increased competition while maintaining compliance with AR 215-1, 8-24b, 8-24c and AR 215-1. 7. Market Research Executive Services conducted market research on 28 March 2017. Results indicated at least three local catering businessesare capable of providing the food and non-alcoholic beverage catering for this event. A review of each caterer's menu's price lists reflected for both lunch and dinner items were comparable to the prices offered by Letort View Community Center (LVCC). These caterers were also within the local vicinity. Per AR 215-1, 8-24.c. FB&E operations "Catering operation", catering operations "These operations provide catered food and beverages as required on the installation. The mission of catering is to respond to the needs of protocol, hosting, command-sponsored events, the social functions of the installation, and the authorized patrons." "The operation will be centralized on an installation and may be located in a stand-alone facility or collocate in another facility such as a community activity center or conference center, or other MWR program. Competing this requirement would be contrary to referenced Army Regulations. Furthermore, per AR 215-1 8-24b "Military Cubs" the mission of military cubs is to satisfy market demands of the total Army Family by providing services such as food and beverage, entertainment, etc...meet the need for command-sponsored events and social function requirements of an installation and its personnel. This is in direct support of the MWR program and any changes in procurement methods may risk the stability of the program. To provide a top quality experience during the reception, avoid deterioration of the served food items and a heightened possibility of foodborne illness, the selected caterer is required to refresh the catered. To do so effectively, safely, in a timely manner and in the quantities required, the caterer should have access to an on post kitchen and a fleet of delivery vehicles that can support the movement of the quantities of catered foods and able to react to last minute shortages. Additionally, excessive surcharges would be assessed by off-post caterers to mobilize and provide catering services and supplies (like linens, tables, chairs, silverware, glasses, paper products, serving trays and utensils) to the installation. Finally, per AR 215-1, 10-8 c, the off-post caterer selected would not be allowed to serve alcoholic beverages on post. According to the market research, the only option that meets these requirement is the Letort View Community Center. With that being established, if alcohol were to be served and an outside caterer were selected, USAWC would incur a large expense in relocating all USAWC attendees of this event to an outside venue. This course of action would increase the force protection concerns for senior civilian distinguished visitors, local dignitaries and military guests. Market research summarizes that although this requirement could be competed, it is not in the government's best interests to do so, based on the previous aforementioned reasons. 8. Procurement History: Previous Purchase Order: Purchase order or contract number: PR# 0010871189 Was action competed? Yes X No If action was not competed, state the cited authority, summarize rationale: FAR 13.106-1(b)(1) Award by other than full and open competition to an off installation source would create additional expenses and difficulties in providing force protection and extend the length and cost of the program due to time lost in movement of personnel on and off post for meals. 9. Additional Information to support the justification. 10. Based on the foregoing, I approve this sole source justification subject to availability of funds, and provided that the services and supplies herein described have otherwise been authorized for acquisition.
