Clauses Statement of Work This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Requirements (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested, and a written solicitation will not be issued. The solicitation number for this requirement is 2017-Q-66774 and is hereby issued as a Request for Quote (RFQ) using FAR Subpart 13.1 Simplified Acquisition Procedures. The Centers for Disease Control and Prevention intends to award a firm-fixed-price contract for the following requirement as stated on the below SOW. Please either provide a quote containing a list of line item number(s) and items, quantities, units of measure, and options, if applicable: CLIN 0001: Total Price Development of a Finite Difference Coal Mine Model Generator $ (All work shall be performed in accordance with the below Statement of Work (SOW)) Your quote shall include the following: • Total Price for the effort • Capabilities in accordance with the Statement of Work and Evaluation Factors Period of Performance: The Government estimated that a 3-month period of performance is necessary for this requirement, however, the Government is open to and invites Vendors to propose a period of performance that is in accordance with their quote and experience. This acquisition is set aside for small businesses under North American Industry Classification System (NAICS) code 541712 and small business size standard 1,000 employees. A Firm-Fixed Price purchase order will be issued in writing to the successful offeror. Scope of work - Development of a Finite Difference Coal Mine Model Generator Estimated Period of Performance: 06/01/2017 - 09/01/2017 BACKGROUND: The work comprises the development of a set of algorithms in the "Fish" programming language that will allow users to efficiently generate finite difference models to simulate longwall coal mine panels using the FLAC3D Version 5 software by Itasca Consulting Group, Minnesota. The intention is for users to enter mine geometric data such as panel dimension, depth of cover, panel locations and geologic layer data in a text file, which will be read by the developed algorithms in FLAC3D to create a layered three-dimensional model with the longwall panels and associated gob areas appropriately located. Within the model a more detailed "area of interest" will be defined in which the FLAC3D zone size will be reduced to allow greater detail of results to be obtained. After completion of the mesh generator development, two case study models will be created and modeled in FLAC3D as a demonstration. DETAILED REQUIREMENTS: MODEL SIZE The model will be a rectangular prizm-shaped block, modeling longwall panels and as many as 100 vertically stacked geological layers of various thicknesses. The thickness of each layer will be constant. Each layer will be a horizontal slab separated from the over/underlaying layers by "interface" elements. It is expected that a model may extend up to 10 km by 10 km in plan view with a vertical thickness of up to 1 km. Geologic layers may vary in thickness from 3m to 50 m. The model shall consist of three types of sub-grids: a) an area of interest grid with smallest zone discretization, b) an inner grid that will contain the panels being mined, and c) an outer grid provided purely to move the model boundaries away from the mining area to limit boundary interaction with the problem area. Within the inner grid it is required to model at least three adjacent longwall panels that are each approximately 500 m wide by 3,000 m long. The specific dimensions and location of each panel is variable. THE AREA OF INTEREST The user will define the location and size of the area of interest in the NIOSH provided text file in a format specified by the contractor. The area of interest shall be located at an arbitrary user defined location in the model and shall extend about 20m above and 10 m below the coal seam being mined. Typical x-y dimensions of the area of interest is expected to be about 500 x 300 m. Zone size is expected to be about 6mx6m in size in plan view with vertical thickness determined by the geologic layer thickness, with a maximum vertical thickness of about 3m. Actual zone size in the area of interest will be one fourth the zone size of the inner grid. Zone sizes surrounding the area of interest shall increase in size in the x-y plane by no more than a factor of 2.0 at a time until the inner grid zone size is matched. Vertical zone thickness will remain unchanged throughout the model, to match geologic layers. THE INNER GRID Zone size within the inner grid is expected to be about 24m x 24m in the x-y plane. The user will define the specific x-y zone size to match pillar width or panel width requirements. Mined panels in the inner grid shall be modeled by removing coal elements and roof rock elements up to a user defined gob height. Mined panels may also intersect the area of interest grid and should be similarly mined with gob height removed. Boundary conditions for the four vertical sides of the inner grid will be specified as either "symmetry" or "infinite". An outer mesh will be provided adjacent to each side of the inner mesh if "infinite" boundariy conditions are specified by the user. For symmetry boundaries, appropriate zero-velocity boundaries will be defined. The "infinite" boundaries of the inner grid will be located approximately 300 m away from the mined longwall panels and the area of interest. The user will specify the exact dimensions in the input text file. THE OUTER GRID The outer grid zone size may be double the inner grid size, and may be stretched by a factor of 1.2 with increasing distance from the inner grid. Vertical zone thickness should match geologic layers within the inner grid (??). The outer boundaries of the outer grid will be about 500m away from the inner grid boundaries. The user will specify the exact dimensions in the input text file. GOVERNMENT PROVIDED ITEMS NIOSH will provide data in the form of a text file(s) with coordinates defining the location of the mined longwall panels, rock layer geometry and rock strength properties in a format specified by the contractor. The text file will be read by the Fish algorithms to use as input for the FLAC3D model analysis. NIOSH will provide two datasets in the form of formatted text files that the contractor will use to demonstrate the developed algorithms. DELIVERABLES • A text file containing "Fish" algorithms that will read user defined inputs and create a FLAC3D Version 5 model of longwall panels as specified in this document. • A PDF document describing the inputs required and format required for generating the models. • A demonstration to NIOSH researchers of two FLAC3D models of NIOSH provided data, presented at the NIOSH Pittsburgh Research Laboratory at the completion of the work. EVALUATION CRITERIA Each offer will be objectively rated. The relative importance of the Technical Proposal Criteria is as follows: Criterion 1 is of more importance than Criterion 2. Criterion 2 is of more importance than Criterion 3. The individual elements that comprise criteria 1, 2, and 3 will not be individually weighted, but rather will be considered as a whole in developing an overall rating for each criterion. While the technical proposal is Technical Proposal Criterion 1: MANAGEMENT, ORGANIZATION, AND STAFFING APPROACH The Offerors proposed management, organization, and staffing approach will be evaluated based on its potential effectiveness and efficiency to successfully provide management and oversight of the contract as a whole. The Offeror will be evaluated on their: • Methods and approach for executing the contract • Approach to monitoring worker productivity and correcting performance deficiencies • Approach to applying lessons learned and new techniques to improve organization and worker efficiency and responsiveness over time • Approach to providing clear lines of communication and lines of authority • Approach to progress monitoring and reporting • Approach to quality control and project control procedures • Ability to provide qualified personnel to fill the key personnel and other management positions • The Key Personnel shall be evaluated on the suitability for the designated position proposed based on education, operational experience, management experience, relevant experience, and professional development based upon the requirements of the contract. Please submit a resume for each Key Personnel Criterion 2: TECHNICAL APPROACH The Offeror's approach will be evaluated to determine the Offeror's understanding of and ability to perform the work associated with the solicitation. The Government will consider the following in the evaluation of the overall approach: • Approach and methodology to performing the requirements identified • Approach to staffing (including appropriate labor categories, skill mixes, roles and responsibilities and DPLH proposed) • Approach to travel and training management • Approach to management of materials and equipment • Reasonableness of schedules • Approach to Management of the contract (e.g. reasonableness of where and how the staff resources align with the organization, lines of communication, and how quality and safety oversight will be provided) Criterion 3: RELEVANT EXPERIENCE The Government will evaluate the Offeror's experience to determine the degree to which it demonstrates the likelihood it can successfully complete the contract. In the case of a joint venture, LLC, or other team arrangement formed for the purpose of competing for this contract, the Government will evaluate relevant experience of the entities that comprise the newly formed entity. Relevant experience includes current or past contracts similar in size, scope, complexity, duration, and/or risk to the work described in this SOW. The Government will use information either furnished by the Offeror's customers and/or information obtained from other independent data sources. CDC will evaluate the experience of the Offeror and any major or critical subcontractors with respect to the type of work proposed and commensurate with the portion of work being performed by each entity. CDC will evaluate the depth and breadth of the experience of the Offeror and major or critical subcontractors. The Offeror will be evaluated on: • Experience. The Government will evaluate the Offeror and all major or critical subcontractors for its relevant experience in performing work similar in size, scope and complexity to that described in the contract. If the Offeror and/or major or critical subcontractor(s) is a newly formed entity with no experience, the Government will evaluate the experience of the parent organization(s) or the member organizations in a joint venture, LLC, or other similar entity. • Verification of Experience. The Government may use information obtained from reference checks and past performance questionnaires to verify experience. PAST PERFORMANCE During its evaluation, the Government will review and consider all relevant past performance information submitted by the Offeror's and/or major or critical subcontractor references, may contact some or all of the references provided by the Offeror and/or major or critical subcontractor, and may solicit past performance information from any other available sources including the DOD Past Performance Information Retrieval System (PPIRS) and the NIH Contractor Performance System. References other than those identified by the Offeror and/or major or critical subcontractor(s) may be contacted and be considered by the Government regarding the evaluation of the Offeror's past performance. The Government may check readily available Government records including pertinent Government prime contracts, or from commercial references for relevant past performance information. The Offeror will be evaluated on: • Quality of Work. The Government will evaluate the Offeror's history in terms of conformance to contract requirements and standards of good workmanship, timeliness and adherence to contract schedules, cost control and adherence to contract cost estimates, customer satisfaction, and stakeholder interface such as relationships with regulators and community relations. • Timeliness (adherence to contract schedules) • Subcontractor management (effective subcontractor management, if applicable) • Customer Satisfaction (provide reasonable and cooperative behavior and commitment to customer satisfaction) • Problem resolution (resolve problems encountered on the contract and implement corrective actions in a timely manner) • Business relationships (demonstrate business-like concern for the interest of the customer) PRICE EVALUATION A price analysis of the quote will be conducted to determine the reasonableness of the Contractor's price. The government will award based upon best value to the government considering both technical and price evaluations. RELATIONSHIP BETWEEN COST OR PRICE AND TECHNICAL STRENGTH Offerors are advised that in the evaluation process, technical merit and other non-cost factors will be more important than price, unless, as a result of technical evaluations, proposals are judged to be essentially equal, in which case price shall become the determining factor. Discussions, if held, will be conducted only with those offerors determined to be within the competitive range. Award shall be made to that responsible offeror submitting the proposal (Technical and Business) determined to be the most advantageous and the best value to the Government as evaluated under the criteria described in this Section. The Government reserves the right to make award without discussions. (Jan. 1999) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The award will be made on the basis of a trade-off evaluation in accordance with the Statement of Work's evaluation criteria. Technical and past performance, when combined, are more important than price. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. (End of Provision) 52.212-3 Offeror Representations and Certifications-Commercial Items (Jan 2017) The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) website located at https://www.sam.gov/portal. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (u) of this provision. (a) Definitions. As used in this provision- "Administrative merits determination" means certain notices or findings of labor law violations issued by an enforcement agency following an investigation. An administrative merits determination may be final or be subject to appeal or further review. To determine whether a particular notice or finding is covered by this definition, it is necessary to consult section II.B. in the DOL Guidance. "Arbitral award or decision" means an arbitrator or arbitral panel determination that a labor law violation occurred, or that enjoined or restrained a violation of labor law. It includes an award or decision that is not final or is subject to being confirmed, modified, or vacated by a court, and includes an award or decision resulting from private or confidential proceedings. To determine whether a particular award or decision is covered by this definition, it is necessary to consult section II.B. in the DOL Guidance. It includes a judgment or order that is not final or is subject to appeal. To determine whether a particular judgment or order is covered by this definition, it is necessary to consult section II.B. in the DOL Guidance. "DOL Guidance" means the Department of Labor (DOL) Guidance entitled: "Guidance for Executive Order 13673, ‘Fair Pay and Safe Workplaces'". The DOL Guidance was initially published in the Federal Register on August 25, 2016, and significant revisions will be published for public comment in the Federal Register. "Economically disadvantaged women-owned small business (EDWOSB) concern" means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. "Highest-level owner" means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner. "Immediate owner" means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees. "Inverted domestic corporation", means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c). "Labor law decision" means an administrative merits determination, arbitral award or decision, or civil judgment, which resulted from a violation of one or more of the laws listed in the definition of "labor laws". "Manufactured end product" means any end product in product and service codes (PSCs) 1000-9999, except- (1) PSC 5510, Lumber and Related Basic Wood Materials; (2) Product or Service Group (PSG) 87, Agricultural Supplies; (3) PSG 88, Live Animals; (4) PSG 89, Subsistence; (5) PSC 9410, Crude Grades of Plant Materials; (6) PSC 9430, Miscellaneous Crude Animal Products, Inedible; (7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products; (8) PSC 9610, Ores; (9) PSC 9620, Minerals, Natural and Synthetic; and (10) PSC 9630, Additive Metal Materials. "Place of manufacture" means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture. "Predecessor" means an entity that is replaced by a successor and includes any predecessors of the predecessor. "Restricted business operations" means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate- (1) Are conducted under contract directly and exclusively with the regional government of southern Sudan; (2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization; (3) Consist of providing goods or services to marginalized populations of Sudan; (4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization; (5) Consist of providing goods or services that are used only to promote health or education; or (6) Have been voluntarily suspended. "Sensitive technology"- (1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically- (i) To restrict the free flow of unbiased information in Iran; or (ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and (2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)). "Service-disabled veteran-owned small business concern"- (1) Means a small business concern- (i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and (ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran. (2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16). "Small business concern" means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation. "Small disadvantaged business concern", consistent with 13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that- (1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by- (i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and (ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and (2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition. "Subsidiary" means an entity in whichmore than 50 percent of the entity is owned- (1) Directly by a parent corporation; or (2) Through another subsidiary of a parent corporation. "Veteran-owned small business concern" means a small business concern- (1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and (2) The management and daily business operations of which are controlled by one or more veterans.
