Memorandum for Record - Limiting Competition at or below the Simplified Acquisition Threshold 1. Contracting Activity: 414th Contracting Support Brigade-RCO Livorno Sub-Office 2. Description of Action: The 405th SFSB - Africa Safety Officer requested a firm-fixed price contract with Firm Ambiente SRL. This contractor shall update the risk assessment Document (DVR) for all the activities controlled or maintained by the unit, in accordance with Italian Legislative Decree 81/08 due to the recent DMC changes. Nature: Revision to preexisting requirement. Contract Vehicle: Purchase Order Pricing/Contract Type: Firm Fixed Price (FFP) Funds: FY 17 (current year) Operations & Maintenance, Army (OMA) Name of Proposed Contractor(s) and Address: Ambiente S.C. Via Frassina 21 54033 Carrara (Massa) Italy Brand Name Buy: No 3. Description of Services or Supplies: AFSBn-AFRICA requests the issuance of one-time firm fixed-price (FFP) contract for the Review and Update of the Existing Safety Risk Assessment Work Manual for Activities Performed in AFSBn-Africa, IAW "Italian Legislative Decree 81/08 and Subsequent Amendments". This is a current year need and FY 17 funds will be used subject to the availability of funding under the continuing resolution. In Italy, health and safety at work are regulated by Legislative Decree 81/08. The decree defines in Italy several European Union occupational health and safety directives, coordinated in a single piece of legislation that provides for specific sanctions against defaulters. Under Decree 81/08, employers are required to comply with precise procedures starting from the drafting of a formal Risk Assessment and safety Work Manual (Documento di Valutazione dei Rischi or "DVR") under the direct liability of the employer. Firm Ambiente completed the original DVR in FY 10 under Purchase order W912PF-10-P-0101. This purchase order was competitively awarded by the RCO for € 18,000 ($ 23,464.83). Since the publication of the document the customer has changed many of the conditions in their facilities to include chemicals, electrical, ergonomics, falls, noise, radiation, temperature, etc. Therefore, an extensive update of this manual is required by Italian law to verify safety conditions in the facilities and to revise the DVR to include any updates for the following areas: A. Activities performed at Shop 1, wheeled vehicle maintenance, building 5150, which has been recently renovated; B. Chemical risk assessment for Paint Shop, building 5881, where new chemicals have been introduced; it should include the verification of all chemical substances presently in use / storage and the related SDSs for presence and conformity / conversion to the current European Regulations and Directives. C. Environmental monitoring and re-evaluation of noise and vibrations, requiring periodical review, to be performed in accordance with applicable Italian UNI norms, with reference to Title VIII paragraph II and III of the Legislative Decree 81/08. D. Identification of potential source of exposure to electro-magnetic fields (new law requirement; Legislative Decree 81/08 was last updated on June 2016). Period of Performance: 01 May - 31 May 2017 (Dates may change depending on award date) Total Value: Estimated at € 8,800/$9,788.65 (Budget Rate: $1 = Euro 0.8990) 4. Authority: FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization. 5. Reasons for Authority Cited: Ambiente SRL is the only responsible company which could revise the original Safety Risk Assessment Work Manual. This determination has been made taking into consideration the following: A. This is a continuation / addition to a critical and technically complex service which is required to be completed by a qualified vendor in accordance with (IAW) Italian Legislative Decree 81/08. According to the Italian law, the environmental monitoring and the related report requested at paragraph 1.6.1.3 of the PWS requires a 48 months review; the original report was prepared by the supplier (Ambiente Srl). B. The vendor provided the original manual and only selected portions of it need updating. However, the vendor making the updates is required to recertify the entire product as being compliant with safety (IAW) Italian Legislative Decree 81/08. They cannot only limit their certification to just the updated portions. Therefore, any vendor, other than the original publisher, would be required to reproduce the entire manual because they cannot recertify another company's work Reproducing the entire manual would considerably increase the cost of the project with little to no gain for the government. C. This partial review is not easily inter-connected with a similar product from another vendor due to variations in how companies catalog standardize and describe the hazards. As is the case for paragraph 5.B, these variations in format and approach would require a complete rewrite. D. The vendor has operational familiarity with the work areas and processes to be re-assessed. Therefore, they would be able to complete the revisions with minimal impact to the customer. In order for a new vendor to complete their work, the customer would be required to walk through every facility with the new vendor to familiarize them and complete an entirely new assessment. This would place a considerable burden on the customer and increase the overall timeline. 6. Publicizing Contract Actions: For FAR Part 13 actions, the public display and synopsis requirements of FAR 5.101 and FAR 5.203 do not apply due to the $ threshold (less than $25K). Requirement to post justification in accordance with FAR 8.405-6(b)(3), FAR 13.105(c), or FAR 16.505(a)(4)(iii)(A): Action is NOT a brand name restriction and is under $150K, no posting required 7. Market Research: N/A. Market research not performed since the KO has determined there is only one responsible source and no other supplies or services will satisfy agency requirements. This is a single, one-time contracting action. Therefore, there are no additional action to take to increase competition 8. Other Facts: N/A
