- Logical Follow-on Modification VA119A-17-J-0282 P00001 was issued on April 27, 2017 (effective May 1, 2017) to serve as a 2-month bridge between the current Office of Capital Asset Management and Engineering Support (OCAMES) Task Order and the award of the next task order for these services (anticipate award late June 2017). This re-compete requirement will be set-aside for Veteran Owned Small Businesses by competing on an existing in-house IDIQ contract. The FAR Part 16 Justification of an Exception to Fair Opportunity supporting this modification is found below. JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY Contracting Activity: Department of Veterans Affairs Office of Acquisition Operations Strategic Acquisition Center- Frederick 321 Ballenger Center Drive, Suite 125 Frederick, MD 21703 Action Being Approved: This justification is for a two-month extension modification for the labor hour task order VA798-11-D-0122 VA119A-15-J-0282 with Booz Allen Hamilton (BAH) for professional engineering program and project management support for a vast portfolio of projects and initiatives within the Office of Capital Asset Management, Engineering Support. Description of the Supplies or Services: The proposed action will extend professional services to assist the Office of Capital Asset Management, Engineering, and Support (OCAMES) with the engineering/facility management programs at VA Central Office (VACO), and across VHA, in all associated owned and leased VHA facilities. OCAMES requires a cadre of contractor professionals with third-party objectivity and credibility ready to respond to short notice tasks, such as developing administration-wide guidance and action plans; facilitating task forces and working groups; providing training; performing analyses to include staffing evaluations and surveys; designing and planning program enhancements and initiatives; managing projects; briefing Leadership; cost estimating, and assessing compliance. This extension will provide a bridge to a future long term ADVISOR task order scheduled to be awarded to a Veteran-Owned Small Business in late June. Work will include the task area of Studies and Analysis, Program and Project Management Support, Management Analyses, Policy Support, Strategic Planning and Performance Measurement, Training, Business Process Reengineering, Business Process Improvement, Business Process Management, Quality Management, and Change Management and Transition. The work requires an On-site Project Manager, a Program Analyst, a Management Analyst, a Facilitator, an Editor, a Technical Writer, Administrative Support, Subject Matter Expertise, document development for publication (including reproduction), and travel and Other Direct Costs (ODCs) as necessary and approved. The estimated value of the acquisition, based on the current task order, is $359,000.00 for two months. Since this is a labor hour task order, the task order ceiling price will increase to $1,865,600.00, an amount that the contractor exceeds at its own risk. This task order, VA798-11-D-0122 VA119A-15-J-0282, was set to expire on April 30, 2017. The modification will extend the period of performance to June 30, 2017. Statutory Authority: The statutory authority permitting an exception to fair opportunity is Section 41 U.S.C. § 4106(c)(3), as implemented by the Federal Acquisition Regulation (FAR) 16.505(b)(2)(i)(C), entitled The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order. The Task order was ordered under this authority and the continuation of the order is supported by the same rationale. Rationale Supporting Use of Authority Cited Above: The work required under the modification is a continuation of activities currently performed under the existing task order. Issuing a short term 2-month modification to the order will avoid disruption of service, duplication of cost to the Government not expected to be recovered through competition, transition delays, and increased costs and therefor is in the interest of economy and efficiency. The Contractor is currently engaged in a number of high impact projects which require development, sequencing, and evolution over a prolonged time period which is projected to exceed the current task order end date of April 30, 2017. Any lapse would be unacceptable due to resulting negative operational and capital project support and monitoring impacts. Utilization of an alternate contractor unfamiliar with direction and work requirements or creation of a new task order would result in completion delays, avoidable transition issues, productivity loses (with resulting economic costs) and an increased risk of additional service lapses. Extending the current work with a two-month extension modification will allow the Government to continue work until the ADVISOR task order is awarded. The contractor personnel provide management support in the area of correspondence management, which has been instrumental in addressing the Program Office s backlog and gains toward meeting SECVA s expectations. Continuity is vital in avoiding any progress set-backs until all correspondence backlogs are resolved. While the long term OCAMES support requirement is suitable for Veteran-Owned Small Businesses (see 8. Actions to Remove Barriers to Competition below), the logical continuation of the current contractor s work will provide the time needed to solicit and award the next contract and time to adequately plan a controlled transition of the work to the new contractor that is awarded the long term task order. Fair and Reasonable Cost: See the Justification Signatures section of this document for the Contracting Officer s determination that the anticipated cost to the Government will be fair and reasonable. Other Facts Supporting the Justification: Past Performance: BAH has provided support to over a dozen OCAMES projects throughout the task order period. BAH has demonstrated the in-depth expertise to handle the breadth of all required tasks; including short fuse and high visibility projects. Tasks have been completed timely with high quality deliverables. Overall, OCAMES finds BAH key personnel meet the task order requirements in terms of required skills, and deliverables have met and exceeded task order requirements. Overall performance is noted as excellent as this time. Actions to Remove Barriers to Competition: A long-term requirement is being developed, and will be solicited and competed under an existing IDIQ contract, and awarded to a Service-Disabled Veteran-Owned Small Business or Veteran-Owned Small Business. Anticipated award of this requirement is late June 2017. In accordance with FAR 5.301 and 16.505(b)(2)(ii)(D)(1), the Government will publish a notice within 14 days of award on Federal Business Opportunities (FBO) and the justification will be posted and made publicly available for a minimum of 30 days.
