JUSTIFICATION REVIEW DOCUMENT FAR SUBPART 13.5 SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL ITEMS - SOLE SOURCE JUSTIFICATION AND APPROVAL 1. Contracting Activity: Army Contracting Command - Aberdeen Proving Ground, 2133 Cushing Street, Building 61801, Room 3212, Fort Huachuca, Arizona 85613-7070 2. Description of Action: The 5th Signal Command requests a modification under authority 52.217-8 Option to Extend Services supporting a sole source logical follow-on effort for the continued use of specialized software warranty support, Juniper Multiprotocol Label Switching (MPLS). The requirement will consist of a four (4) month period beginning 22 May 2017, and ending 21 September 2017. Support will be a Firm Fixed Price (FFP) contract under the procedures of FAR Part 13.5, and Operations and Maintenance Army (OMA) Fiscal Year 2017 funds will be used. An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B). 3. Description of Supplies/Services: This acquisition is in support of Hardware and Software Warranty support, Juniper Multiprotocol Label Switching (MPLS). The Juniper Multiprotocol Label Switching (MPLS) establishes a barrier between secure and trusted internal network and other networks that are not assumed to be secure and trusted. This is done by analyzing and filtering packages in real-time which will allow it to respond to the threat immediately. This allows operators to more efficiently analyze, capture and dispose of the threat by optimizing the integrity of the IP data networks in support of USAREUR and the SSC (T) area of operation (AO). This warranty will provide the updates, software, hardware replacement, and telephonic support when required. The software code, licenses, and repair parts required are all proprietary. This contract for warranty support of Juniper MPLS equipment for the time period 22 May 17 through 21 September 2017 4. Authority Cited: Simplified Procedures for Certain Commercial Items, 41 U.S.C. 1901 as implemented by FAR Subpart 13.5, Sole Source 5. Reason for Authority Cited: This is a sole source requirement for Juniper Multiprotocol Label Switching (MPLS) device warranty. 5th Signal Command currently uses the Juniper Multiprotocol Label Switching (MPLS) devices to establish a barrier between secure and trusted internal network and other networks that are not assumed to be secure and trusted. Without this warranty support, all connected network devices in the European theater currently operating under Juniper Multiprotocol Label Switching (MPLS) construct will fail, resulting in an unprotected IP network and 100% failure of the mission. The only alternative to a sole source warranty modification would be a wholesale replacement of all Juniper Multiprotocol Label Switching (MPLS) equipment which would not be cost effective and is not in the best interest of the Government. Under the alternative scenario the Government would need to devise methods to recover costs in excess of $ for current replacement of Juniper Multiprotocol Label Switching (MPLS) infrastructure; these costs serve as justification for continuing support of the Juniper Multiprotocol Label Switching (MPLS) warranties. 6. Efforts to Obtain Competition: Efforts to obtain competition for this action are not feasible nor is it in the Government's best interest based on the rationale in paragraph five; however, a special notice synopsis for a sole source contract was posted to the Federal Opportunities website (FedBizOpps) on 03 May 2017, and made available for public inspection and comment. The closing date for the synopsis is 10 May 2017. To date, no companies have expressed an interest in performing, or have provided comments for this effort. Approval of this J&A allows the Government to award a contract to Copper River Information Technology, LLC. 7. Actions to Increase Competition: A special notice synopsis for a sole source contract was posted to the Federal Business Opportunities website (FedBizOpps) on 03 May 2017, and made available for public inspection, comment, and to see if there are any other interested vendors. If there is any future Juniper MPLS support requirement, every effort will be afforded to compete to the maximum extent possible to alleviate long term sole source dependency. 8. Market Research: Market research was conducted via the internet (Feb. 2017) and future competition for these services are readily available on the Computer Hardware Enterprise Software and Solutions (CHESS), Information Technology Enterprise Solutions, Hardware (ITES-3H) multiple award IDIQ contract, as well as open market. In addition to market research, a special notice synopsis for sole source contract was posted on Federal Business Opportunities (FedBizOpps) website on 03 May 2017, and made available for public inspection and comment. The closing date for the synopsis is 10 May 2017. To date, no companies have expressed an interest in performing, or have provided comments for this effort. 9. Interested Sources: To date, no other sources have written to express an interest. See Paragraph 6 for the synopsis information. 10. Other Facts: Procurement History: Contract was awarded on 22 May 2012 and expires 21 May 2017, as a Firm-Fixed Price purchase order. The contract was awarded as a brand name requirement with limited sources to Copper River Information Technology, 1577 C Suite 201, Anchorage, AK. 99501-5164. 11. Technical Certification: I certify that the supporting data under my cognizance, which is included in this justification, is accurate and complete to the best of my knowledge and belief. 12. Fair and Reasonable Cost Determination: I hereby determine that the anticipated cost or price to the Government for this contract action will be fair and reasonable. Price analysis techniques per FAR 15.404-1 will be used in performing the price analysis. Price analysis will clearly demonstrate that the proposed price is reasonable in comparison with current or recent prices for the same or similar services. Certified cost and pricing data is not required as the service being acquired is considered commercial. 14. Contracting Officer Certification: I certify that this justification is accurate and complete to the best of my knowledge and belief.
