Description
THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. This is a notice of intent to award a sole source contract under statutory authority 10 USC 2304(c) (1), set forth in Federal Acquisition Regulation 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The National Park Service, Northeast Region, New York Major Acquisition Buying Office intends to award a sole source contract to Statue Cruises, LLC for rental of daily vessel transportation services of NPS staff, U.S. Park Police (USPP), concessionaire staff, contractors, partners, volunteers and VIPs to Ellis and Liberty Islands from Lower Manhattan (Battery Park, NY) and return. A three month purchase order is anticipated. Period of performance is June 1, 2017 through August 31, 2017. The North American Industry Classification (NAICS) Code is 48212, Inland Water Passenger Transportation with a small business size standard of 500 employees. Market research indicates that only Statue Cruises, LLC is permitted to load/off-load passengers onto Ellis and Liberty Islands from Battery Park, NY and only Statue Cruises, LCC has assigned land and real property improvements of the passenger docking areas at Ellis and Liberty Islands. a.Statue Cruises, LLC is also the Park's concessionaire contractor under contract CC-STLI001-07, which provides ferry service to the general public at the Statue of Liberty National Monument and Ellis Island for the period of April 1, 2008 through September 30, 2019. Exhibit C of CC-STLI001-07 discusses the assigned land and real property improvements to Statue Cruises, LLC, which includes the arrival dock at Liberty Island and the bulkhead and pier for docking (fender system and slips) at Ellis Island. Due to these assignments, other contractors are prevented from providing services at the islands' passenger embarkation and disembarkations areas. b.A 2007 license agreement between Statue Cruises, LLC and the New York City Parks and Recreation Department provides Statue Cruises, LLC the exclusive use of operation and maintenance of the docking facilities, walkways, and fender systems of landing slips 3, 4 and 5 at Battery Park in Lower Manhattan. Battery Park is under the jurisdiction of New York City Department of Parks & Recreation. NPS security protocol requires that all persons traveling via vessel from Battery Park, NY to Ellis and Liberty Islands must pass through airport-style security screening prior to boarding the staff vessels. Airport-style screening is only available in Manhattan at the Battery Park screening tent. This license agreement prevents other interested parties from competing for this contract because loading slips 3, 4, and 5 are operated by Statue Cruises, LLC and the loading slip ¿s walkways and passenger embarkation and disembarkation area directly connect to the Battery Park screening tent. Other vessel transportation companies are not permitted to use these landing slips while this license agreement is in place. This ten-year license agreement expires December 2017. In accordance with FAR Part 5.207(c) (15) (ii), the proposed contract action is for services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302-1(b)(1)(i). This notice of intent to award is not a request for competitive proposals; however responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination by the Government not to compete this requirement based upon responses to this notice is solely within the discretion of the Government. Interested persons may identify their interest and capability to the requirement no later than May 22, 2017 2:00 PM Eastern Daylight Time.
