Other Than Full and Open Competition (OFOC) Single Source Justification over $150K Page 2 of 2 JUSTIFICATION FOR SINGLE SOURCE AWARDS IAW FAR 13.106-1 (OVER SAT THRESHOLD($150K)) IAW FAR13.104, COs must promote competition to the maximum extent practicable to obtain supplies and services from the source whose offer is the most advantageous to the Government, considering the administrative cost of the purchase. When competition is not practicable, IAW FAR13.106-1(b), COs solicit from a single source for purchases not exceeding the simplified acquisition threshold. COs may solicit from one source if the CO determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). IAW FAR13.106-3(b)(3),COs are required to include additional statements explaining the absence of competition (see 13.106-1 for brand name purchases) if only one source is solicited and the acquisition does not exceed the simplified acquisition threshold (does not apply to an acquisition of utility services available from only one source) or supporting the award decision if other than price-related factors were considered in selecting the supplier. This template when completed can be used to document single source awards IAW FAR13.106-3(b)(3). Note: Statements such as "only known source" or "only source which can meet the required delivery date" are inadequate to support a sole source purchase. 1. PURCHASE REQUEST OR REQUISITION NUMBER: 618-17-3-4008-0688 1A. PROJECT/TASK NUMBER 1B. ESTIMATED AMOUNT: $262,073.54 2. BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED AND THE INTENDED USE: Fixed-price sole-source service agreement on the Leica equipment in the clinical department. The Service Maintenance Agreement includes the following: SCOPE: Leica shall provide all support maintenance for the Minneapolis VA for the following systems: BOND-III slide staining processing module, Leica equipment S/N 3210830 BOND-III slide staining processing module, Leica equipment S/N 3211059 BOND-III slide staining processing module, Leica equipment S/N 3211407 Services provided under this standard service agreement include: Emergency repair service as required during the hours of 07:00am - 05:00pm, Monday through Friday. Labor, travel and replacement parts, as required. At least one planned maintenance inspection(s) per period (Base + 4 OPTN YRS). CONTRACT PERIOD: Contract base period shall begin 6/1/2017 and end on 5/31/2018, with the option of exercising up to four option years. QUALIFICATIONS: All support of the Leica equipment covered by this agreement shall be performed by Leica. Equipment: Equipment may be added or deleted from the service contract as needed upon notification by the Contracting Officer (to be documented in writing via contract amendment). Deleted equipment will be credited in the full amount if deleted before any maintenance has been performed on it. 3. UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES CAN BE USED: This service contract is of a proprietary nature to the manufacturer, Leica. Leica is the only Contractor qualified and certified to provide service on the Leica equipment. Leica is the OEM and is the only source available and authorized to provide service coverage. There are no SDVOSB/VOSB businesses certified and authorized to provide this required service. 4. REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE, WHICH CAN PROVIDE THE SUPPLIES OR SERVICES: Leica is the OEM and is the only source to provide service coverage. 5. DESCRIPTION OF MARKET RESEARCH CONDUCTED AND RESULTS OR STATEMENT WHY IT WAS NOT CONDUCTED: If other certified or qualified and OEM-trained companies become available to repair this equipment in the future, new sources will be sought. 6. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b).
