Description
Draft Statement of Work The National Institute of Standards and Technology (NIST) intends to negotiate on a sole source basis, under the authority of FAR 13.106-1(b) (1), with FMB Oxford Ltd. located at Units 1-4 Ferry Mills, Osney Mead, Oxford, OX2 0ES United Kingdom, to modify the existing Beamline system with a Resonant Soft X-Ray Scattering (RSoXS) Through Station. The sole source justification is based on the following: The Material Measurement Laboratory's Polymers Processing Group of the Material Science and Engineering Division awarded the NIST Beamline SST to FMB Oxford Ltd. under contract SB1341-14-CN-0042. NIST now requires a RSoXS that can be incorporated and removed from the Beamline as needed for experimentation. See the attached Draft Statement of Work for the draft requirements. As the initial system developed for NIST under the previously mentioned contract is proprietary to FMB Oxford, and because the Government does not possess the data rights to the component designs used in the current Beamline, no other company reasonably exists that will possess the required proprietary parts, knowledge, and procedures to build and integrate the RSoXS into the Beamline SST. Additionally, due to the sensitivity and precise compatibility requirements of the system, using products from any other vendor aside from FMB Oxford would result in a total loss of the Beamline system integrity. Specific changes to the previously procured equipment include: -removing a beam pipe and ion pump, -accommodating the insertion of a new radiation shutter in upstream piping, and -inserting a new in-line measurement station that includes multiple sample holders and multiple detectors that must be inserted into and withdrawn from the beam,while ensuring that: 1. all new components fit perfectly to a tolerance within a few microns, 2. the downstream beam path is unperturbed in normal operation, 3. the ultra high vacuum levels are maintained throughout the beamline, and 4. the new controllers and manipulators are fully compatible with other beamline equipment, controllers, and computers. Failure to meet these requirements in full would put the previous ~$7.6 million procurement at risk of catastrophic failure and equipment damage or destruction. The resulting purchase order will be a Firm Fixed Price purchase order. The NAICS Code is 334516 with a size standard of 1,000 employees. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested parties who regard themselves as capable of fulfilling these requirements are invited to submit responses to the Government for consideration. Responses received by 11:00 am EST 07/02/2017, will be considered by the Government. Responses should include information about capabilities and previous projects similar to the draft requirement. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
