- Notice of Intent to Sole Source Subject: Maintenance Agreement to cover the AR-G2 Rheometer Instrument for a base year (12 Months), plus 3 option years, totaling 4 years for the life of the contract. Notice of Intent to Sole Source to: - TA Instruments Inc. Pursuant to the authority of 41 USC 3304(a)(1), as implemented by Federal Acquisition Regulation (FAR) Subpart 6.302-1, the Food and Drug Administration (FDA) intends to award a Sole Source firm-fixed price purchase order to procure a maintenance Agreement for a base year (12 Months) and 3 option years to TA Instruments Inc., located at 159 Lukens Drive, New Castle, DE, 19720 -2765. The Food and Drug Administration (Center for Devices and Radiological Health) requires a Preventative Maintenance Agreement for the AR-G2 Rheometer Instrument for a base year (12 Months), plus 3 option years, totaling 4 years for the life of the contract. TA Instruments Inc., is the manufacturer of the equipment for which the Preventative Maintenance Agreement is being requested. TA Instruments Inc., is the most knowledgeable of the operation and maintenance of their own systems. FDA requires this service to be provided by the manufacturer's certified or approved technician and the manufacturer does not authorize third party service providers. In a sole source letter submitted to the Contract Specialist, TA Instruments Inc., states that: "TA Instruments is the sole manufacturer approved service provider for these instruments. All service related repairs and/or calibrations are to be completed by only specifically trained TA service representatives. TA Instruments scientific test equipment requires specific knowledge and specific calibration equipment, available only from TA Instruments, in order to ensure the instrument's integrity and performance. Third party providers do not obtain the knowledge and/or TA specific calibration equipment to accurately repair and/or calibrate these instruments." However, any party that believes it is capable of meeting this requirement as stated herein may submit a written capability statement that clearly supports and demonstrates their ability to perform the requirement. Capability statements must be received by the response date and time of this notice. Submissions will be reviewed to determine if they can meet the requirement. A determination by the Government to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. It is anticipated that an award will be issued to TA Instruments Inc., within approximately fifteen (15) days after the date of this notice unless the Government determines that any other organization has the capacity to meet this requirement.
