Description
DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) For Other Than Full and Open Competition (>$150K) Acquisition Plan Action ID: VA259-17-AP-7042 Contracting Activity: The agency responsible for this acquisition is: The Department of Veterans Affairs, VISN 19, Eastern Oklahoma VA Health Care System (EOVAHCS), 1011 Honor Heights, Dr., Muskogee, OK 74401. The Department of Veterans Affairs proposes to enter into a contract on the basis of other than full and open competition for Philips Healthcare IntelliVue Information Center iX. Purchase request 623-17-03-2295-0010. Nature and/or Description of the Action Being Processed: This is a new procurement and the contract contemplated will be a firm-fixed-price sole source procurement. The action is to upgrade our current telemetry system which is in critical failure. Description of Supplies/Services Required to Meet the Agency s Needs: The VA is purchasing new components and replacing certain components for the current patient monitoring system for PACU, Endoscopy, ED, Telemetry, and ICU. This equipment shall permit a user to view all networked monitors associated with the particular care area. This shall include, but not be limited to, a large high quality display, most recent version of software, mounts, UPS and all connections and accessories to accommodate the remote monitoring functionality. Statutory Authority Permitting Other than Full and Open Competition: (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; Brand Name in accordance with FAR 13.501 ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; FAR 13.5 Simplified Procedures for Certain Commercial Items: The authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C 1901 and is implemented for restricting competition on this procurement via FAR 13.106-1(b)(2). Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): No other manufacturer can provide this system since this facility utilizes the Philips Healthcare monitoring system. This system has been installed in this facility as the main patient monitoring system. This system is failing, beyond economical repair. Unusual and Compelling Urgency (FAR 6.302-2, 6.303-2(a)(9)(ii)) This system is critical to our daily operations. We currently have 24 telemetry transmitters (telemetry sets) and 11 ICU monitors in which we monitor telemetry activities. When the telemetry system is down we would have to fee out as many as 6 patients per day on average or a cost of (6 X $5,000 = $30,000). Our commitment to our Veterans is to provide all possible care within our capabilities. Within the last month we have lost the ability to monitor up to 50% of our patients for brief periods of time due to the fragility of the system. Biomed states that this system could become inoperable at any time but continue to monitor it on an ongoing basis.
