- In accordance with Federal Acquisition Regulation (FAR) Part 13, Simplified Acquisition Procedures, the U.S. Department of Energy (DOE), National Energy Technology Laboratory (NETL) intends to award a purchase order on a sole source basis to Rigaku Americas Corporation to renew the annual service contracts for ZSX Primus II spectrometer and Ultima III x-ray diffractometer for the base period of performance of June 01, 2017, to May 31, 2018, and up to two, one-year option periods. This is considered a sole source to Rigaku because, to the best of the NETL ™s knowledge based on market research conducted, Rigaku is the only known source that can provide this service and maintain these instruments. This is a premium service contract and coverage includes parts, labor, and consumables. The maintenance and repair service coverage includes two preventative maintenance visits per unit per contract period; 48 hour/best effort on-site service response time by a qualified Rigaku service representative; and technical phone support. NETL must be a Rigaku maintenance agreement/service contract customer because the 48 hour/best effort on-site service response time is required. To assure continued reliable operation of these units, exact replacement parts must be obtained and utilized from the original equipment manufacturer (OEM), which is Rigaku Americas Corporation. The OEM maintains proprietary information on the systems ™ designs, service procedures, electronics, attachments, and calibration methods. The OEM (Rigaku) is the only capable vendor to provide this service, and as informed by Rigaku, any service performed on Rigaku equipment by outside parties will make any warranties associated with Rigaku products null and void. No known potential alternate sources exist which could satisfy NETL's requirement. This notice of intent is not a request for quote/proposal. Any interested party that believes it is capable of meeting the NETL requirement described herein may identify themselves and must provide evidence of their capability to fulfill the requirement being requested by 5:30 PM ET on June 14, 2017. Responses must be submitted in writing to the purchasing agent, Lora Stumpf, via email at stumpf@netl.doe.gov no later than the time and date noted above. Telephone responses and requests will not be received. A determination by the Government not to compete this requirement based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
