- THIS IS NOT A REQUEST FOR PROPOSAL - THIS IS A NOTICE OF THE GOVERNMENT'S INTENT TO ISSUE A SOLE SOURCE AWARD CONTRACT TO ASHENFELTER & ASHMORE, LLP, TO PROVIDE EXPERT WITNESS/CONSULTANT SERVICES TO ASSIST THE U.S. DEPARTMENT OF LABOR'S (DOL) OFFICE OF FEDERAL CONTRACTS COMPLIANCE PROGRAMS (OFCCP). DOL intends to negotiate and award a labor hour contract with Ashenfelter & Ashmore, LLP for expert witness services to assist OFCCP in an upcoming compensation discrimination case. The contractor will provide opinions on whether there is statistical evidence of discrimination; construct and finalize databases; perform statistical analyses, including multiple regression analyses; critique opposing expert's statistical analyses; calculate remedies; assist in discovery and trial preparation; and possibly assist in preparing for settlement discussions. Each of these steps may include deposition and trial testimony and written documentation. The period of performance for this action will be date of award through 12 months thereafter, plus two 12 month option periods, for a total three year potential period of performance. The associated North American Industry Classification System (NAICS) Code is 541110 - Offices of Lawyers, which has a size standard of $11 million. The statutory authority for this non-competitive action is Federal Acquisition Regulation (FAR) 6.302-3, Industrial mobilization; engineering, developmental, or research capability; or expert services, 10 U.S.C 2304(c)(3). This is a sole source notice published for informational purposes only and not a request for competitive proposals. Therefore, no solicitation document exists for this requirement. However, all responsible parties interested in responding to this notice are invited to submit a capability statement by 5:00 p.m. EDT, June 2, 2017, that provides sufficient details for consideration by the Government, via email to: Taylor.Nicole.D@dol.gov. The determination not to compete the contract based on the responses to this notice is solely within the discretion of the Government. Phone calls will not be accepted in response to this notice. All information submitted should support the offeror's capability to provide the items required, and shall be furnished at no cost or obligation to the Government. Responses must be in writing and must provide clear and concise documentation indicating an offeror's bona fide capability to provide these services. Verbal responses are not acceptable and will not be considered. The Government reserves the right to cancel this requirement.
