Description
DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) For Other Than Full and Open Competition (>$150K) Acquisition Plan Action ID: VA69D-17-AP-4941 Contracting Activity: Department of Veterans Affairs, VISN 12, Great Lakes Acquisition Center, Center, 115 South 84th Street, Suite 101, Milwaukee, WI 53214-1476. Purchase request 695-17-3-6127-0019. Nature and/or Description of the Action Being Processed: This is a limited sources justification for a new firm-fixed price contract in accordance with FAR 13.5, Simplified Procedures for Certain Commercial Items, for a one-time service to move the security points from the Metasys system to the Pegasys system (P-2000) system located within the Clement J. Zablocki, VA Medical Center, Milwaukee. Description of Supplies/Services Required to Meet the Agency s Needs: The Contractor will provide and install all necessary input/output modules, cabinets, power supplies and CK721A controllers needed for the P2000 system. Contractor will also remove unneeded Metasys trunks (wiring and modules only, not to include conduit) after migration. Installation of the P2000 equipment includes wiring, programming and testing of the new points, programming and commissioning of the new system. The total estimated value is $164,609.57. Period of performance is from time of contract award to October 31, 2017. Statutory Authority Permitting Other than Full and Open Competition: ( X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The Pegasys/P2000 system is proprietary to Johnson Controls. The current system at the Milwaukee VAMC under contract GS06F0060P/VA69D-16-F-4795 is the existing system and is currently running under the P2000. This requirement converts and upgrades the current Metasys system to the P2000 system for buildings 4,5,6,7,43,70,111,112,113 and the Crash Test Building. No other vendor has access to the proprietary P2000 system being serviced by Johnson Controls. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: No other efforts were made to solicit other vendors. The current security system integrates into the P2000 hub which is proprietary to Johnson Controls. The cost of removing the entire system to allow for more competitors would be astronomical and not in the best interest of the government to spend at this time. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Components of the service include GSA pricing and other materials and labor are open market pricing. The Contracting Officer will request discounted pricing of both GSA and open market materials and services. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: As described in Section VI above, market research, in accordance with FAR Part 10, was conducted by synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties. An intent to sole source (VA69D-17-Q-0999) was posted to FBO from 4/27/17 to 5/8/17, no responses were received. Additional market research was not conducted due to the proprietary P2000 system. Any Other Facts Supporting the Use of Other than Full and Open Competition: Due to the proprietary system integrated by the P2000, a Statement of Work will not be developed and will not be available. Johnson Controls proprietary system must integrate with all security upgrades not available by other vendors. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Johnson Controls, Inc was the only vendor that expressed interest in the acquisition. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: To remove or overcome barriers to competition, the VA would have to install a whole new system which would not be economically advisable and not in the Government s best interest. Due to proprietary rights of security infrastructure vendors limit access to their systems to maintain integrity therefore, no actions are planned at this time for competition.
