This Sources Sought is for information purposes only and does not constitute a commitment, implied or otherwise, that a procurement action will be issued or awarded. No entitlement to payment of direct or indirect cost or charges by the Government will arise as a result of the submission of information. All information considered proprietary shall be marked accordingly. The Government shall not be liable for or suffer any consequential damages for improperly identified proprietary information. Properly identified proprietary information will be safeguarded in accordance with federal regulations. The purpose of this announcement is solely to gather information from the marketplace, and any responses received will neither be considered an offer by the responding party nor returned to the responding party. No telephone inquiries will be accepted, and requests for solicitation packages will not be honored since no solicitation has been prepared. Background: The National Marine Fisheries Service (NMFS), Pacific Islands Region, requires the recruitment, selection, supervision, and outfitting of all sea-going personnel needed to fulfill federal fisheries obligations of the Pacific Islands Region Observer Program (PIROP). The PIROP currently includes the Hawaii deep-set tuna and shallow-set swordfish longline fleets, and the longline fleets of American Samoa. NMFS has the obligation to monitor and to obtain estimates of the incidental take of sea turtles, other protected species, and other by-catch in the pelagic, groundfish and, other fisheries that fall under federal jurisdiction. Data are required to assess the potential impact of the fisheries on sea turtles and other protected species, specifically: loggerhead, olive ridley, leatherback, and green turtles, seabirds, and marine mammals. Observer coverage aboard vessels with federal fishing permits is required by the "reasonable and prudent measures" (RPMs)and terms and conditions of the Incidental Take Statement (ITS) of the NMFS biological opinion on the effects on federally-listed threatened and endangered species of pelagic fisheries managed under the Fishery Management Plan (FMP) for the Pelagic Fisheries of the Western Pacific Region. The issuance of these two opinions resulted from interagency consultations pursuant to Section 7 of the Endangered Species Act (ESA). The biological opinion for the pelagic fisheries concluded that the fisheries are adversely affecting sea turtles, but that they are not likely to jeopardize the continued existence of the species. The ITS authorizes lethal, incidental taking of turtles in the longline fishery, but contains non-discretionary reasonable and prudent measures that must be undertaken by NMFS, including the establishment of an observer program. The mandatory observer program is operated under the authority of the Pelagic Fishery FMP established under the Magnuson Fishery Conservation and Management Act (MSFCMA) in response to concerns regarding interactions with listed threatened and endangered sea turtle species. Requirements: See the attached draft Statement of Work for requirements. Information Requested: Interested companies should describe their capabilities as they relate to the following: • Adaptability - ability to respond to emerging and expanding needs of their sponsors and anticipate future critical issues; and • Objectivity - ability to produce thorough, independent analyses to address complex technical and analytical problems. In addition to addressing technical capabilities, responses must include the following: • Name and address of firm • Size of business (i.e., small, small disadvantaged business, woman owned, etc.) • Average annual revenue for the past 3 years and number of employees • Ownership • Number of years in business • Affiliate information • Parent company, joint venture partners, potential teaming partners, prime contractor (if potential subcontractor) or subcontractors (if potential prime contractor) • List of customers covering the past five years (highlighting relevant work performed, contract numbers, contract type, and dollar value of each procurement) • Point of contact - address and phone number; Submittal Requirements: Telephone responses are NOT solicited and will not be accepted. No solicitation exists; therefore, do not request a copy of the solicitation. This Source Sought notice is not to be construed as a commitment by the Government to award a contract, nor will the Government pay for the solicited information.
