Description
This is a Notice of Proposed Contract Action under FAR Part 12 Acquisition of Commercial Items and FAR Part 13 Simplified Acquisition Procedures. This notice is for information only; a solicitation will not be issued. THIS IS NOT A REQUEST FOR PROPOSAL. The associated North American Industry Classification System (NAICS) code is 333314 with a size standard of 500 employees. Semrock is currently the only manufacturer that provides commercial off the shelf (COTS), narrow band-pass filters with transmission above 90% in the ranges 367 - 373 nm and 394 - 406 nm, providing good filtering with low loss. Suitable filters meeting the Government's requirements were not found from other vendors. Additionally, Semrock is the only source for a COTS utrabroadband mirror with average reflection of at least 99% in the 350-1100 nm range. The sole distributor for Semrock products for Government Labs is AVR Optics. Market research conducted by the end user has confirmed that only one manufacturer exists that provides the narrow band-pass filters with the needed transmission, above 90% in the ranges 367 - 373 nm and 394 - 406 nm, providing good filtering with low loss & an utrabroadband mirror with average reflection of at least 99% in the 350-1100 nm range, which is Semrock. An internet search identified multiple providers of beamsplitters and filters, however, no other manufacturer was found that meets the specifications described. The sole distributor for Semrock products to Government Labs is AVR Optics. This is a notice of proposed contract action and NOT a request for competitive proposals. However, all responsible sources may submit a capability statement or proposal, which shall be considered by the agency. Responses to this notice must be submitted by the date/time listed on the notice. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government in future procurements. Responses received will be evaluated; however a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. The Government anticipates an award date on or before 31 July 2017. "Notice to Offeror(s)/Suppliers(s): Funds are not presently available for this effort. No award will be made under this solicitation until funds are available. The Government reserves the right to cancel this solicitation, either before or after the closing date. In the event the Government cancels this solicitation, the Government has no obligation to reimburse an Offeror for any costs." A Sole Source Justification will be attached to the subsequent Notice of Award.
