Description
The Department of Health and Human Services on behalf of the Assistant Secretary for Administration and the Office of the Chief Information Officer is issuing this RFQ for the purchase of: Instructions to Quoters The Department of Health and Human Services on behalf of the Assistant Secretary for Administration and the Office of the Chief Information Officer is issuing this RFQ for the purchase of: Hardware device JA2500 model JA2500-A-BSE with support item SVC-ND-JA2500BSE. This hardware device will run the Junos Space Network Platform. This platform provides central administration, management, support, and logging for all the Juniper security devices deployed in the CSO environment. Evaluation will be based on lowest price technically acceptable (LPTA). Quotes are due by 11:00 AM ET on June 23, 2017. Quotes received by the government after the submission deadline will not be accepted. Questions should be sent to Thien Nguyen at Thien.Nguyen@psc.hhs.gov no later than 12 noon on June 9, 2017 Period of Performance: Date of Award through 12 Months Brand Name Justification The purpose of this procurement is to provide a dedicated hardware device to run the Junos Space Network Management Platform. This platform provides central administration, management, support, and logging for all the Juniper security devices deployed in the CSO environment. This security equipment brand name is Juniper. Any other brand name would not seamlessly integrate into the CSIRC management solution. Also Juniper hardware, support, and maintenance are an integral in maintaining CSO's existing architecture. CSO has licensed and is currently using Juniper software and hardware product(s) to support customer's corporate security and compliance needs as a foundational network infrastructure component. Contract should be limited to only suppliers that are authorized Juniper resellers and are certified to provide Juniper support. FAR 52.203-98, Prohibition on Contracting with Entities that Require Certain Internal Confidentiality Agreements - Representation (FEB 2015) (a) In accordance with section 743 of Division E, Title VII, of the Consolidated and Further Continuing Resolution Appropriations Act, 2015 (Pub. L. 113-235), Government agencies are not permitted to use funds appropriated (or otherwise made available) under that or any other Act for contracts with an entity that requires employees or subcontractors of such entity seeking to report fraud, waste, or abuse to sign internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information. (b) The prohibition in paragraph (a) of this provision does not contravene requirements applicable to Standard Form 312, Form 4414, or any other form issued by a Federal department or agency governing the nondisclosure of classified information. (c) Representation. By submission of its offer, the Offeror represents that it does not require employees or subcontractors of such entity seeking to report fraud, waste or abuse to sign internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information. (b) The contractor shall notify employees that the prohibitions and restrictions of any internal confidentiality agreements covered by this clause are no longer in effect. (c) The prohibition in paragraph (a) of this clause does not contravene requirements applicable to Standard Form 312, Form 4414, or any other form issued by a Federal department or agency governing the nondisclosure of classified information. (d)(1) In accordance with section 743 of Division E, Title VII, of the Consolidated and Further Continuing Resolution Appropriations Act, 2015 (Pub. L. 113-235), use of funds appropriated (or otherwise made available) under that or any other Act may be prohibited, if the Government determines that the Contractor is not in compliance with the provisions of this clause. (2) The Government may seek any available remedies in the event the contractor fails to comply with the provisions of this clause. 3. FAR 52.232-40, PROVIDING ACCELERATED PAYMENTS TO SMALL BUSINESS SUBCONTRACTORS (DEC 2013) (a) Upon receipt of accelerated payments from the Government, the Contractor shall make accelerated payments to its small business subcontractors under this contract, to the maximum extent practicable and prior to when such payment is otherwise required under the applicable contract or subcontract, after receipt of a proper invoice and all other required documentation from the small business subcontractor. (b) The acceleration of payments under this clause does not provide any new rights under the Prompt Payment Act. (c) Include the substance of this clause, including this paragraph (c), in all subcontracts with small business concerns, including subcontracts with small business concerns for the acquisition of commercial items.
