Description
This is not a request for quotations or an announcement of a forthcoming solicitation, but merely notification of the Social Security Administration's (SSA) intent to issue, on a sole-source basis, a firm fixed-price delivery order to Reed Elsevier, Inc., DBA LexisNexis, against their Library of Congress FEDLINK contract for access to their online Lexis.com, Courtlink and Accurint databases. Under the authority of Federal Acquisition Regulations (FAR) Part 6.302-1, the Contracting Officer has determined that the circumstances of the contract action deem only one responsible source and no other supplies or services will satisfy agency requirements. The Lexis.com, Courtlink and Accurint databases are only available from its producer and manufacturer and not through dealers or distributors. The period of performance will be for twelve months, beginning September 29, 2017 through September 28, 2018. The Accurint database contains public records information that is heavily used in components throughout SSA to combat fraud and abuse in the administration of agency programs. Lexis.com and Courtlink are used extensively in legal components, including the Office of the General Counsel and the Office of Disability Adjudication and Review, and are essential to the successful completion of critical agency work involving Social Security claims that have been appealed to the administrative or federal court level. The Lexis.com database includes federal and state codes, cases, regulations, and specialized treatises. Courtlink includes court dockets and documents. The Lexis online subscription provides access to legal materials including texts and law reviews, primary source materials, and specialized practice materials. The subscription also includes Shepard's Citations, public records information that is critical to preventing fraud and abuse in Social Security's benefits programs, docket and docket information that is essential for defending SSA in litigation and case management software that allows for the orderly management of electronic discovery and legal files. LexisNexis also provides customized XML and batch processing services that assist operations with the verification of information provided by claimants and representative payees.The specific databases that are included in the subscription are: • Lexis.com for Legal Research • Accurint.com for Public Records Research • Courtlink.com for court dockets and documents research • CaseMap, TimeMap and Concordance for case management software Specific titles in the LexisNexis subscription are proprietary and include: • NOSSCR Social Security Practice Guide • CCH Social Security Reporter • Disability Compliance Bulletin • Administrative Law (Stein) • Collier on Bankruptcy • Corbin on Contracts • Government Contracts: Law, Administration & Procedures (McBride) • Corporate Acquisitions and Mergers (Fox) • Labor and Employment Law (Lareau) • Larson on Employment Discrimination • Moore's Federal Practice • Weinstein's Federal Evidence • Larson's Workers' Compensation Law • The Complete Guide to Medicare Secondary Payer Compliance • Treatise on Health Care Law (Lundy) • Health Care Law: A Practical Guide (Becker) • Immigration Law and Procedure (Gordon) • Appleman on Insurance 2d A determination by SSA not to compete this proposed requirement based upon responses to this notice is solely within the discretion of SSA. Information received will be considered for the purposes of determining whether to conduct a competitive procurement. The Government does not intend to pay for information provided in response to this notice. Written responses to this notice shall contain sufficient documentation to establish a bona fide capability to fulfill this requirement. Responses shall be submitted by 9:00AM ET on June 12, 2017. If SSA does not receive an acceptable response to this announcement by June 12, 2017, negotiations will be conducted with LexisNexis as the only source and a purchase order will be issued without any additional notices being posted.
