- Justification for Other Than Full and Open Competition, Succeeding Lease U. S. General Services Administration GSA Region 4 Lease Division – Branch D JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION LEASE NUMBER: GS-04B-43118 PROJECT NUMBER: 3NC0229 Agency Name: SSA 1. IDENTIFICATION AND DESCRIPTION OF ACTION BEING APPROVED. The General Services Administration currently leases 7,500 Rentable Square Feet (RSF) with a Common Area Factor (CAF) of 1.155624037 yielding 6,490 ANSI BOMA Office Area square feet (ABOA) at 1187 Andy Griffith Pkwy Mount Airy, NC 27030-2528 under lease number GS-04B-43118 for the SSA. The current lease expires March 28, 2015. The SSA office would like to remain in its’ current location. Approval is requested to negotiate a succeeding lease with the incumbent lessor without full and open competition for continued occupancy at this leased location. 2. DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED SSA submitted a continuing need letter on July 10, 2013 for 7,500 rentable square feet of office and related space. To satisfy SSA’s mission requirements as well as to adhere to recent SSA directive regarding space requests, the SSA office desires to remain in the current location which has been deemed suitable to meet the agency’s requirements with minimal alterations. The SSA must remain in its current location in the current facility in order to save on duplication and relocation costs. This requirement is for 7,500 RSF of space with a Common Area Factor (CAF) of 1.155624037 yielding 6,490 ANSI BOMA Office Area square feet (ABOA) for a 10 year, 5 year firm term to commence on March 29, 2015. The estimated annual cost of this lease is $18.00 per RSF /$20.80 per ANSI/BOMA per year for an annual cost of $135,000 during the firm term and a total contract value of $1,220,418.86 (Gross Aggregate Contract). The delineated area is North: Westlake Dr, East: W. Lebanon, South: Hickory St., West: Galax Trail. 3. IDENTIFICATION OF STATUTORY AUTHORITY. 41 U. S. C. 253(c) (1): Only one responsible source and no other supplies or services will satisfy agency requirements. 4. DEMONSTRATION THAT THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED. There is only one other available building in Mt. Airy, NC with the potential to meet the agencies needs. This building located at REDACTED. REDACTED Therefore SSA should remain at the current location, 1187 Andy Griffith Pkwy, because there is only one responsible source and no other supplies or services will satisfy agency requirements. 5. DESCRIPTION OF EFFORTS TO SOLICIT AS MANY OFFERS AS PRACTICAL. GSA placed an advertisement conforming to GSAM 570.402-2 on the Federal Business Opportunities Web site (fedbizopps.gov) on September 16, 2013 as a Notice of Intent to Solicit for Other than Full and Open Competition. The Leasing Specialist conducted a telephone/internet market survey and identified two potentially acceptable locations (one plus the incumbent) that might meet the agency’s needs within the delineated area. The incumbent lessor’s expression of interest indicated that the rate would be $18.00 per RSF fully serviced. 1187 Andy Griffith Pkwy Mount Airy, NC (incumbent) REDACTED 6. DESCRIPTION OF MARKET SURVEY CONDUCTED. OTHER FACTS SUPPORTING USE OF OTHER THAN FULL AND OPEN COMPETITION. Not applicable. 8. LIST OF SOURCES THAT EXPRESSED INTEREST IN THE ACQUISITION. Bray S. Recapping Service, Inc (Incumbent) 9. STATEMENT OF ACTIONS TO OVERCOME BARRIERS TO COMPETITION. Not applicable. 10. TECHNICAL REQUIREMENTS PERSONNEL CERTIFICATION. I certify that the supporting space requirements data used to form the basis of this Justification is complete and accurate to the best of my knowledge and belief. <img src="file:///C:/Users/QUOVAD~1/AppData/Local/Temp/1/msohtmlclip1/01/clip_image002.gif" alt="Microsoft Office Signature Line..." width="256" height="128" /> 11. CONTRACTING OFFICER CERTIFICATION AND DETERMINATION THAT THE ANTICIPATED COST WILL BE FAIR AND REASONABLE. Recent market research conducted by GSA in Mount Airy, NC, for comparable properties within the agency’s delineated area showed that the rental rate within the delineated area for those properties ranges from $6 to $18 per RSF (Note: Tenant Improvement not included). The cost quoted to the Government by the current Lessor, at the existing location, is $18 per RSF. There is only one other available building in Mt. Airy, NC with the potential to meet the agencies needs. This building located at REDACTED.
