Description
Terms and Conditions This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This procurement is being conducted under Simplified Acquisition procedures pursuant to the authority of FAR Subpart 13.5, Test Program for Certain Commercial Items (10 U.S.C. 2304(g) and 2305 and 41 U.S.C. 253(g) and 253a and 253b), FAR Part 12, Acquisition of Commercial Items (Title VIII of the Federal Acquisition Streamlining Act of 1994 (Public Law 103-355)), FAR 37.104, Personal Services Contracts (Public Law 103-332, Department of the Interior and Related Agencies Appropriation Act, Title II, September 30, 1994, 108 Stat. 2530 as implemented by 25 U.S.C. 1638c) and FAR Subpart 37.6, Performance-Based Acquisition. This announcement constitutes the only solicitation; therefore, a written solicitation will not be issued. The Billings Area Indian Health Service (IHS) intends to award a firm fixed-price, performance-based, commercial item contract in response to Request for Quotation (RFQ) 10-17-014-EB. This solicitation is being solicited on an unrestricted basis. The solicitation documents and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-09. The associated North American Industry Classification System code is 621512 and the small business size standard is $12.5 million. PRICE SCHEDULE - COMPUTER TOMOGRAPHY (CT) TECHNOLOGIST: BASE PERIOD: 9000 hours @ tiny_mce_marker_______ per hour = tiny_mce_marker_________; OPTION ONE: 9000 hours @ tiny_mce_marker_______ = tiny_mce_marker_______; OPTION TWO: 9000 hours @ tiny_mce_marker_______ = tiny_mce_marker_______; OPTION THREE: 9000 hours @ tiny_mce_marker_______ = tiny_mce_marker_______; OPTION FOUR: 9000 hours @ tiny_mce_marker_______ = tiny_mce_marker_______; PURPOSE OF THE CONTRACT: The purpose of this acquisition is to contract for a CT Technologist to provide weekday coverage at the Blackfeet Service Unit, PHS Indian Hospital on the Blackfeet Indian Reservation, Browning, Montana. Coverage is required Monday through Sunday to provide 24/7 coverage for the radiology department, with 8,10, and 12 hour shifts. Changes may be made to the scheduled days and shifts as needed to accommodate department schedule and hospital needs. Major Duties: Independently performs complex computerized axial tomographic (CT) scanning of heads, bodies, and extremities. It is initially anticipated that between 75 to 125 procedures will be performed each month. Receives patient, explains method of procedure, positions patient, and enters necessary data into the computer for examination prescription. Determines exposure factors to achieve optimum radiographic technique with a minimum of radiation exposure to the patient. Examines radiographs for the purpose of evaluating technique, positioning, and other pertinent technical qualities. Exercises discretion and judgment in the performance of medical imaging procedures. Independently makes examinations after conferring with radiologist to establish examination requirements. Examines patient medical records for allergic history and laboratory renal function results. Administers iodine contrast intravenously to patient. Recognizes physiological changes in specific patient situations that require modification of standard operating procedures in order to obtain adequate data that yields diagnostically useful clinical information. Schedules patients for examinations. Provides patient education. Evaluates the nature of critical and emergency procedures and rearranges patient priorities to accommodate them. Maintains records of patients treated, examinations performed, scans taken, etc. Maintains permanent record of scans in an archive library. Retrieves tapes from the library and shows CT scans to the radiologists or referring physician for diagnostic evaluation. Notifies the radiologist or physician of significant scans requiring immediate attention and visualization while patient is undergoing examination. Makes preliminary diagnostic evaluation. Transmits all CT and radiographic images for professional interpretations to outside facility. Makes minor adjustments to equipment such as setting up wedges or changing transverse length adjusters. Performs preventive maintenance as required. May operate film processing machines. Monitors scanner and computers for any malfunction so that corrective action can be taken as part of the CT Quality Assurance Program. Performs primary maintenance, calibration and quality control procedures. Develops policies and or protocols for performing various patient procedures at Blackfeet Community Hospital and asists department in updating JCAHO requirements and works on developing PI plans or actions. Performs routine X-Ray examinations and assists other technicians in the department when not providing CT services. Is available for emergency and call back services. General tour of duty will be for 40 hours per week. Documents all patient compliance issues and or complaints. Performs other duties as assigned KNOWLEDGE AND EXPERIENCE REQUIRED: Thorough knowledge of radiation protection standards, devices, and techniques including concepts of accumulated dosage and genetic changes, effects of radiation on living organisms, and the affects of x-ray/CT techniques on patient and operator exposure in order to assure that adequate safeguards are maintained to recognize when changes of equipment or procedures might result in increased exposure, and to adopt methods to prevent such exposure. Knowledge of physiology, and cross sectional anatomy such as the location, appearance, and function of the various major and minor systems susceptible to exposure and the physical abnormalities associated with most diseases or lesions to recognize scans which illustrate the lesion and develop them through control of contrast, density, etc., to optimize their clarity for diagnostic use; and to recognize when additional or different positions are needed to fully illustrate the lesion. Knowledge of basic physics including the concepts of energy, electric power and types of electrical circuits, construction and use of x-ray tubes and the properties of x-rays in order to understand the operation of X-Ray/CT equipment, monitor the equipment for proper operation, make changes to standard procedures to compensate for equipment aging, and determine when maintenance or repair is needed. Must have a thorough knowledge of the various computer software programs including Smartools productivity software, Lightspeed QX/i operating software, MPR, MPVR, ProtocoI Pro II, Prospective Multiple Reconstruction, Segmentation, and the Dynamic scanning program. The contractor must also have the skill to teach methods and procedures to members of the technical and scientific staff. Possesses a wide range of computer experience including a sophisticated understanding of computer hardware, a detailed knowledge of a variety of operating systems, scanner operation programs developed by the manufacturers, and locally produced software. Also effectively uses high level command languages and high powered data and image analysis programs. Knowledge of radiographic exposure techniques such as use of formulae for determining technical factors and use of wedges to collimate the x-ray beam and bolus bags to reduce density discontinuities. Knowledge of first aid in order to monitor and respond to patient medical responses in the scanning process. SCOPE AND EFFECT: The purpose of the work is to provide x-ray and CT imaging studies for diagnosis and treatment of patients presenting at Blackfeet Community Hospital for routine, critical or emergency care. Clear and accurate images are essential to enable the providers to evaluate and treat the patient conditions. Careful and knowledgeable application and development of these imaging techniques by the contractor is necessary in order to produce high quality clinical data. Results of CT images my lead to early detection and a more detailed undetstanding of a wide variety of disease processes. PERSONAL CONTACTS: Contacts include patients, family members, hospital employees, contractors, vendors, and professional staff at outside facilities. PURPOSE OF CONTACTS: Communication with patients on specific procedures given, results expected and medical attention provided. May need to discuss patient care with other providers and family members as well. PHYSICAL DEMANDS: Lifting, bending, stooping, standing, listening, walking, sitting and responding to a wide variety of patients during the course of the day is required. The work requires long periods of standing and walking. Positioning patients who are seriously ill requires considerable effort and working in akward positions. WORK ENVIRONMENT: Contractor is required to perform duty during day or evening shift and on an on call emergency basis as needed. Location of work area is well lighted and temperature controlled. However, exposure to radiation is likely and requires contractor to adhere to all safety policies and protect self, patients and staff from exposure. SUPERVISION: The Contractor is subject to the supervision and direction of the Radiology Department Supervisor or his/her designee. The services will be monitored, as necessary, for conformance to policies, regulations, and timeliness. Due to the contract nature of this position and the complexity of the daily operation there is no direct daily supervision of this position. Typically, the CT procedures are specified by the attending physician, but the contractor develops the detailed methods to achieve the objectives. The contractor is responsible for performing protocol studies and maintaining the associated data base utilizing the existing PACs system. Only unusual problems in these areas are resolved in consultation with the supervisor. Periodically, the completed data base is reviewed for overall acceptability and completeness. Contractor independently performs scanning/examinations. SUPERVISOR: Tim Davis, Director of Professional Services; ALTERNATE: Jonie Hines, Acting Clinical Director. GUIDELINES: Contractor will work under all established policies and procedures including safety and appropriate medical by-laws of the Blackfeet Community Hospital. Standard operating procedures cover the section to be illustrated, the interval and number of scans to be taken, use of contrast medium, positioning of the patient, and technical factors to be used. Textbooks, technical manuals and research papers on computerized axial tomography are available for additional guidance. Many guidelines are not specifically applicable to the assignment since CT scanning is a rapidly evolving part of Diagnostic Radiology and the GE unit recently installed at the Blackfeet Community Hospital is very new. The technologist must modify the procedures and guidelines to compensate for observed physiological and anatomical conditions peculiar to the patient in order that the lesions existing should be most effectively illustrated. The technologist must conduct studies in the field of computerized axial tomography to recommend new methods, examinations, and guidelines for adoption. Procedures change frequently due to new developments in the field. COMPLEXITY: The CT contractor works independently and performs scans of patients utilizing a GE goldseal lightspeed QX/i Xtream 3D Smart Prep L2600JL CT unit via a teleradiological network service link with an outside facility and consults with an offsite radiologist under the general direction of the physician in charge or provider ordering the CT procedure/image. PERIOD OF PERFORMANCE: July 1, 2017, through June 30, 2018, with four option periods. GOVERNMENT FURNISHED PROPERTY: The IHS shall provide all medical equipment and supplies. The Blackfeet Service Unit will be responsible for getting the Contractor access and clearance to all pertinent ARMS; intranet, internet, and computer services necessary to carry out his/her duties. COMPUTER SECURITY: All Federal agencies are required by the Federal Information Security Management Act of 2002 (FISMA) to complete a course in Computer Security Awareness Training (CSAT). Within HHS, there is a requirement for this training to be completed annually by all employees including all contractors, volunteers, students, summer externs, etc. PERFORMANCE-BASED SERVICE DELIVERY SUMMARY: The contract CT Technologists performance will be measured based on the following Performance Requirements: (1) Quality of Performance; (2) Shift Coverage; (3) Customer Service; (4) Departmental Safety and QA monitoring; and (5) Provides Technical Assistance and operational training to Radiology staff. The Performance Requirements will be measured against the following Government Performance Standards: (1) Provide professional CT imaging services as specified in the Performance Work Statement; (2) Must be available for shift coverage in CT and radiology; (3) 5 or more customer complaints; (4) Complete procedures in accordance with applicable JCAHO requirements and Blackfeet Service Unit by-laws, rules and regulations; and (5) Instructs and or updates staff on an as needed basis. The Method of Government Surveillance to determine compliance with the Performance Requirements are as follows: (1) Written evalutions from outside firm performing interpretations and conferences between contractor and project officer; (2) Random sampling by project officer; (3) Validated Complaints; (4) Random Sampling by project officer; and (5) Submits detail of orientation and list of attendees. Deduction Schedule: A 5% deduction shall be assigned to each Performance Requirement. Deductions shall be assessed against individual invoices when services are not performed or do not meet contract requirements. CONTRACTING OFFICER AUTHORITY: Authority to negotiate changes in the terms, conditions or amounts cited in this contract is reserved for the Contracting Officer. Contracting Officer Representative: The COR shall be responsible for: (1) Monitoring the Contractors technical progress, including surveillance and assessment of performance and recommending technical changes; (2) Interpreting the Statement of Work; (3) Technical evaluation as required; (4) Technical inspections and acceptance; and (5) Assisting the Contractor in the resolution of technical problems encountered during performance of this contract. INVOICE SUBMISSION AND PAYMENT: The Contractor shall submit its invoice to the Billings Area Office Attention: Finance, 2900 Fourth Ave North, Billings, MT 59417 with a courtesy copy to the COR at the Blackfeet Service Unit, PHS Indian Hospital, P.O. Box 760, Browning, Montana 59417. The Contractor agrees to include the following information on each invoice: (1) Contractors name, address; (2) Contract Number; (3) Invoice number and date; (4) Cost or price; (5) Dates of Service including the number of hours worked; and (6) Remit to address. Payment shall be made by the Billings Area Financial Management Branch, P.O. Box 36600, Billings, Montana 59107. REPORTING REQUIREMENTS: The Contractor shall provide the Contracting Officer with evidence that payment of employment taxes has been made 15 days after each quarter. PRO-CHILDREN ACT OF 1994: The Contractor certifies that it will comply with the provisions of Public Law 103-227, Pro-Children Act of 1994, which imposes restrictions on smoking where Federally funded children's services are provided. CHILD CARE NATIONAL AGENCY CHECK AND INVESTIGATION (CNACI). A CNACI must be completed for all Indian Health Service (IHS) contractor personnel within the Billings Area. Public Law (P.L.) 101-630, Indian Child Protection and Family Violence Prevention Act and P.L. 101-647, Crime Control Act of 1990, require the IHS to conduct a character and criminal history background investigation on all contractors performing services in IHS facilities. The character and background investigations will be conducted by the Blackfeet Service Unit. SPECIAL CONTRACT REQUIREMENTS: Contractors cannot serve as expert witnesses in any suit against the Federal Government. Many of the IHS patients receiving services may only speak a native language and/or reside on a Native American Reservation, therefore, the Contractor must demonstrate sensitivity to cross-cultural and language differences. The Privacy Act of 1974 mandates that the Contractor maintain complete confidentiality of all administrative, medical and personnel records, and all other pertinent information that comes to his/her attention or knowledge. The Privacy Act carries both civil and criminal penalties for unlawful disclosure of records. Violation of such confidentiality shall be cause for adverse action. The IHS shall provide training on the Freedom of Information Act and the Privacy Act. All IHS regulations and policies applicable to these Acts shall be enforced. The Contractor shall comply with IHS facility infection control and safety procedures, practices, and standards. Federal Tort Claims Act coverage for medical related claims is extended to the individual providing CT Technologist Services. However, the services must have been performed within the scope of the personal services contract. Contractor must be Finger printed and have backgrounds checks completed and passed before allowed to start contract. PROVISIONS AND CLAUSES: The following provisions and clauses apply to this acquisition. The FAR provision 52.212-1 Instructions to Offerors Commercial Items; and 52.212-3 Offeror Representations and Certifications Commercial Items are incorporated by reference. The provision at 52.212-2 applies to this acquisition and is provided in full text. FAR 52.212-2 EVALUATION-COMMERCIAL ITEMS (JAN 1999): (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: (1) Certified CT/RT - 20 POINTS. Offeror must submit copy of certificate; (2) Education - 15 POINTS. Graduate of a professional school accredited by a nationally-recognized body, appropriate for the members professional discipline; (3) Experience with patient population - 20 POINTS. Offerors past and current professional experience dealing with American Indians and Alaska Natives and/or experience in providing services on a reservation or in remote locations; (4) Suitability -15 POINTS. (a) Previous denial or revocation of medical staff membership at another facility; (b) Previous reduction, suspension, revocation, voluntary relinquishment, or non-renewal of privileges at another facility; (c) Problems with alcohol or drug abuse; (d) Previous loss, suspension, restriction, denial, or voluntary relinquishment of professional licensure or professional society membership; and (e) Health status; and (5) Past Performance - 30 POINTS. Technical and past performance, when combined, are considered approximately equal to cost or price. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. The following FAR and Health and Human Services Acquisition Regulation (HHSAR) clauses are applicable: 52.204-4, 52.204-9, 52.212-4, 52.212-5, 52.215-5, 52.217-6, 52.217-7, 52.217-8, 52.217-9, 52.223-5, 52.223-6, 52.224-1, 52.224-2, 52.229-3, 52.232-3, 52.232-18, 52.237-2, 52.237-3, 52.242-15, 52.242-17, 52.245-1, 52.245-2, 52.249-12, 352.202-1, 352-215-1, 352.215-70, 352.223-70, 352.232-9, 352.270-2, 352.270-3, 352.270-4, 352.270-6, and 352.270-7. The following FAR clauses cited in 52.212-5 are applicable to the acquisition: 52.203-6 with Alternate I, 52.219-8, 52.222-3, 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37, 52.222-39, 52.225-13 and 52.232-33. CONTRACTORS INTENDING TO CONDUCT BUSINESS WITH THE FEDERAL GOVERNMENT MUST REGISTER WITH THE DEPARTMENT OF DEFENSE CENTRAL CONTRACTOR REGISTRATION (CCR) DATABASE. PROPOSAL SUBMISSION INSTRUCTIONS: The Contractor shall provide evidence of, or submit a written response to, the technical evaluation factors in FAR 52.212-2. In addition, the Contractor shall submit a completed copy of FAR 52.212-3 with its offer. All responsible offerors may submit a proposal, which shall be considered by the Agency. Offers shall be submitted to the Blackfeet Service Unit, 760 Hospital Circe, Browning, Montana 59417, no later than 3:00 p.m., on June 23, 2017. The offer must be submitted in a sealed envelope, addressed to this office, showing the time specified for receipt, the solicitation number, and your name and address. Offers will also be accepted by e-mail at eric.butterfly@ihs.gov or by fax at (406) 338-3202. ACCEPTANCE PERIOD: Your proposal must stipulate that it is predicated upon all the terms and conditions of this RFQ. In addition, it must contain a statement to the effect that it is firm for a period of at least 90 days from the date of receipt by the Government.
