- NOTICE OF INTENT FOR SOLE SOURCE: The National Institute of Standards and Technology (NIST) Acquisition Management Division received a Sole Source justification for the purchase of a software license and warranty support for the Cobham/Aeroflex TM500 Long Term Evolution- User (LTE-U) hardware, to Aeroflex Wichita, Inc., 10200 W. York St, Wichita, KS 67215. This procurement is for the acquisition of a sole source commercial items using simplified procedures in accordance with FAR Part 13. The North American Industrial Classification System (NAICS) number is NAICS code of 511210, Software Publishers and the business size standard is $38.5 million. a. Only one responsible source and no other item will satisfy the NIST requirement. b. Aeroflex Wichita is the only approved source for the software license and warranty support for the Cobham/Aeroflex TM500 hardware. There is no other vendor that can supply the software license and warranty support for Cobham/Aeroflex hardware and meet the NIST requirements. c. This request is issued for the NIST Communications Technology Laboratory (CTL). Aeroflex Wichita is the only known source that meets the NIST requirements. Contract delivery is 30 days after receipt of order (ARO), and warranty support is from 12/12/2017 - 12/11/2018. This synopsis is for informational purposes only and does not constitute a solicitation for bids or proposals. DO NOT submit a bid/quote at this time. Any offerors believing they can provide the required Aeroflex Wichita software license and warranty support for the TM500 equipment as described above may provide evidence for consideration. Evidence must support the offeror's claim they can provide this brand name or equal. All qualified sources may submit a response, which if timely received, will be considered by this agency. Information received will be considered solely for the purpose of determining whether a competitive procurement can be conducted. A determination not to compete this proposed procurement based on response to this notice is solely within the discretion of the Government. Responses must be received NLT 4:00 pm Mountain Standard Time (MST) on 13 June 2017. Responses received after this will be considered late IAW FAR 52.212-1(f) and will not be evaluated. Responses are required to be sent email to susan.mckean@nist.gov. The Government does not intend to pay for any information provided under this announcement. Contractors must have a current registration with the System for Award Management (SAM) http://www.sam.gov The Government intends to award a Firm Fixed Price contract processed IAW FAR 12 and 13. The closing date of this synopsis is 4:00 pm Mountain Standard Time (MST) on 13 June 2017.
