Chapter VI: Other Than Full and Open Competition (OFOC) SOP Attachment 3: Request for Sole Source Justification DEPARTMENT OF VETERANS AFFAIRS Brand Name Justification and Approval (J&A) For Other Than Full and Open Competition (>$1SOK) Acquisition Plan Action ID: VA259-17-AP-7079 Contracting Activity: Department of Veterans Affairs, VISN 19, Denver Medical Center Descriotion of Suoplies/Services Reguired to Meet the Agency's Needs: The requested action will be awarded as a new firm fixed priced contract. This requirement is for supplies for the Electrophysiology lab, at the VA Denver Medical Center at a total cost of $REDACTED. The base year of four (4) months is $REDACTED, and the one (1) year option is $REDACTED. This will allow Cardiology Services to continue to provide electrophysiology procedures to veterans in their new EP lab. Statutory Authority Permitting Other than Full and Open Competition: ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; (X) (2) Brand Name FAR 6.302-1; ( ) (3) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (4) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (5) International Agreement per FAR 6.302-4 ( ) (6) Authorized or Required by Statute FAR 6.302-5; ( ) (7) National Security per FAR 6.302-6; ( ) (8) Public Interest per FAR 6.302-7; Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The new lab was outfitted with a radiofrequency ablation generator manufactured by St Jude Medical. Other types of equipment and accessories not allowing for interconnectivity or interoperability with other manufactures equipment or accessories. Only the St. Jude EP catheters are compatible with the St. Jude radiofrequency ablation generator that has already been acquired for the EP laboratory. The patent number for the St. Jude EP catheters is US 9,585,587. S. Description of Efforts Made to emure that offers are solicited from as many ootential sources as deemed practicable: Market research conducted found one distributor, Veterans Healthcare Solutions (VHSS).FedMine was utilized by the Small Business liaison to find distributors of St. Jude. Only VHSS was found and verified by St. Jude as an authorized VA distributor. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: GSA, SAC, and NAC contracts were surveyed and only one multiple award contracts through the SAC was found, and it is awarded to St. Jude. St. Jude has one SDVOSB distributor, VHSS.VHSS is an authorized distributor for the Veterans Affairs. The Director of Cardiac Electrophysiology at ECHCS has surveyed the EP market, including discussion with various vendors about their products both locally and at vendor booths at national cardiology meetings several times per year. Market research revealed that the EP catheters will soon be added to the Medical Surgical formulary contract with the SAC so a multi-year contract does not make sense for this requirement.
