Description
JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1. Contracting Activity. This justification is executed by the Naval Medical Logistics Command, Fort Detrick, Maryland. 2. Description of the Action Being Approved. The government intends to award a sole source contract to Parata Systems, LLC (Parata) for pharmacy dispensing system support services at Naval Military Treatment Facilities (MTFs) worldwide military treatment facilities on behalf of the Defense Health Agency (DHA) Pharmacy Operations Division (POD). 3. Description of supplies/services. Parata is currently providing the required pharmacy dispensing system support services under Task Order N62645-14-F-0015 which expires 01 April 2017. The new contract is for the same services provided under the expiring contract, i.e., preventive and corrective maintenance services for pharmacy dispensing systems, including the following: Parata Pharmacy 2000 workstations, Parata MAX, and Parata Mini. The expiring contracts also includes regularly scheduled preventive maintenance, inspections, calibrations, and corrective maintenance tasks, and unlimited emergency repair actions. These services are required to be performed by an original equipment manufacturer (OEM) authorized vendor. The Government intends to award a firm fixed price contract for the required services with a period of performance from 02 April 2017 through 01 April 2022. The total estimated dollar value of the resultant contract is $8,800,000.00. It is anticipated that Fiscal Year 17 Defense Health Program funding will be utilized. 4. Statutory Authority Permitting Other Than Full and Open Competition. 10 U.S.C. 2304(c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements 5. Rationale Justifying Use of Cited Statutory Authority. Parata is the only vendor that can provide support to proprietary Parata equipment. Parata is the original manufacturer of this equipment. No other vendor can provide hardware and software updates to proprietary Parata equipment or provide updates to the prescription drug database that can interface with proprietary Parata medication dispensing systems. Parata has the intellectual rights and service knowledge to provide support to Parata equipment. Parata is the only vendor capable of providing updates to the proprietary software, which is required to maintain DoD Information Assurance Certification and Accreditation Process (DIACAP) approval and remain on the Navy network. DIACAP will eventually be replaced by the Risk Management Framework (RMF) process. Parata will be required to obtain RMF approval upon expiration of the current DIACAP ATO (Authorization to Operate). If another vendor were to provide services to the required equipment, it would result in loss of DIACAP approval, delays in patient care, and unnecessary risks to patient safety. No other vendor is capable of providing services and support to this medication dispensing equipment. Accordingly, Parata is the only vendor that has the capability to perform the work successfully. 6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable. A sources sought notice was posted to FedBizOpps on 17 January 2017 with a closing date of 24 January 2017; however, no responses were received. Additionally, a notice of intent to award a sole source contract to Parata will be posted to FedBizOpps upon approval of this document.   7. Determination of Fair and Reasonable Cost. Prior to award, the Contracting Officer will make a determination that the award price(s) are fair and reasonable. It is anticipated that the price analysis conducted will utilize the Government's independent cost estimate and Parata's Federal Supply Schedule for pharmacy dispensing systems, including support services at CONUS locations. 8. Actions to Remove Barriers to Future Competition. See Paragraph 6. This requirement represents a non-competitive follow-on acquisition of services previously awarded on a non-competitive basis. At this time, no new sources could be located. For future requirements, market research will be conducted to identify potential sources. A copy of the previous justification is attached to assist the approval authority in determining whether the planned actions to remove any barriers to competition cited on the previous justification were completed. 9.
