- This notice is to advise industry that the Space and Naval Warfare Systems Center (SPAWARSYSCEN) Atlantic, Charleston, SC, intends to extend the period of performance for the subject multiple award contracts in support of Business and Force Support (BFS) (Unrestricted, 8(a), and SBSA), Transport and Computing Infrastructure (TCI) (Unrestricted and 8(a)), and Decision Superiority (DS) Support Services (SBSA), from 180 days to 11 December 2019 (See Attachment 1). This extension is necessary for future compliance of the recently sustained Harris IT Services Corporation (Case # B-411699) and AllWorld Language Consultants, Inc. (Case # B-411481.3) cases upheld by Government Accountability Office (GAO) where task order period of performance exceeded the prime contract expiration and permitted performance beyond the 180 days specified in FAR Clause 52.216-22. This extension period is planned to allow currently awarded task orders to complete performance or those requirements that cannot be awarded through an existing internal or external contract vehicle. Once the future command wide contracts are awarded, it is not the intent of the Government to issue new task orders under these extensions. This extension is necessary to permit the continuity of services to meet the current and immediate future demands of SPAWARSYSCEN Atlantic. This action is being pursued on a sole source basis under the statutory authority of 10 U.S.C. 2304(c)(1), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. This Notice of Intent is not a request for competitive proposals. Any response to this notice must show clear and convincing evidence that competition of the work required would be advantageous to the Government. A determination by the Government not to compete this contract period of performance extension based on this notice is solely within the discretion of the Government.
