- Required Chemicals List Provisions and Clauses - Multiple Chemicals Statement of Work - Multiple Chemicals This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6 - Streamlined Procedures for Evaluation and Solicitation for Commercial Items, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested, and a written solicitation document will not be issued. This solicitation is being issued using Simplified Acquisition Procedures under the authority of FAR Part 13 Simplified Acquisition Procedures. This solicitation is a Request for Quotations (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-95 effective 1/19/2017. The associated North American Industrial Classification System (NAICS) code for this procurement is 325199 with a small business size standard of 1,250 employees. This acquisition is being procured under a Total Small Business Set Aside. The Mass Spectrometry Data Center (MSDC) at the National Institute of Standards and Technology (NIST), Material Measurement Laboratory (MML) Biomolecular Measurement Division (BMD) is responsible for the development of the NIST, National Institute of Health (NIH), and Environmental Protection Agency (EPA) Mass Spectral Library and Tandem Mass Spectral Database. To carry out this mission, the MSDC has a need to acquire chemicals of organic compounds and various other types of chemicals, including hazardous, industrial and environmental chemicals, pesticides, regular drugs and drugs of abuse and their metabolites, metabolites, poisons, synthetic chemicals. NIST intends to issue one or multiple purchase order awards as a result of this solicitation. SPECIFIC REQUIREMENTS The contractor shall perform the requirements identified in the attached Statement of Work and its attachment, Required Chemicals Lists. EVALUATION CRITERIA AND BASIS FOR AWARD Award shall be made to the Contractor that provides the lowest priced, technically acceptable quote for each Contract Line Item (CLIN) which conforms to the solicitation requirements (see Required Submissions section). NIST is utilizing a streamlined solicitation to procure these chemicals, potentially resulting in multiple purchase order awards. CLINs 0001,0002, and 0003 are each separate procurements. The requirements are being streamlined into one solicitation for the sake of efficiency, and to minimize administrative burdens, however, each CLIN should be regarded as a distinct requirement for the purposes of quote submission. A contractor may bid on one, some, or all the CLINs at their discretion. If the same vendor is selected for award of multiple CLINs, NIST may elect to consolidate the successful quotes into one purchase order, again to minimize administrative burdens. NIST will award each of the CLINs contained in the Required Chemicals List to the lowest priced, technically acceptable quote for that particular CLIN. Technical acceptability means that the quote meets the stated minimum specifications and complies with the solicitation requirements. Technical Capability: Evaluation of Technical Capability shall be based on the information provided in the quotation. NIST will evaluate whether the Contractor has demonstrated that the offered product(s) meet or exceed the requirements of the Statement of Work. Contractors do not need to provide a quotation for 100% of the chemicals in a CLIN. To be considered technically acceptable for a CLIN, the contractor must provide a quotation for at least 80% of the listed chemicals. Price: For each CLIN, the evaluated price will be the total overall price, inclusive ONLY of the chemicals quoted by ALL contractors responding to at least 80% of the required chemicals for that CLIN. In other words, amongst technically acceptable (i.e., > 80% fulfillment) quotations compliant with the solicitation requirements for a particular CLIN, only the quoted chemicals listed under that CLIN that all other technically acceptable quotations have in common will be used as a basis for price evaluation. However, the awarded price will be the total price of all chemicals (not just those in common) quoted by the contractor whose quotation is determined to be the lowest priced, technically acceptable solution for that CLIN. REQUIRED SUBMISSIONS All Contractors shall submit the following: 1. Pricing Submission: Using the Required Chemicals List spreadsheet, the Contractor shall submit a firm-fixed-price quotation for all available chemicals for any CLINs for which the Contractor wishes to submit a quotation. To be considered technically acceptable, the Contractor must provide a price quotation for at least 80% of the chemicals for a particular CLIN. The Contractor shall input its unit price into the highlighted column of the attached Required Chemicals List spreadsheet. All chemicals required are needed in a quantity of 1mg. If a contractor elects not to submit a quotation for a particular CLIN, the contractor should delete that Tab from the Spreadsheet, so that the Spreadsheet submitted contains only those tabs/CLINs under which the contractor is submitting a quotation. Contractors shall use the Excel spreadsheet provided, and shall not submit pricing in any other format, such as PDF or MS Word. 2. Cover Letter: The Contractor shall submit a cover letter that addresses the following requirements, as applicable. The contractor may include any other information that is deemed necessary in the cover letter. a. Confirmation that the Contractor can comply with the entirety of the Statement of Work requirements. b. If the Contractor objects to any of the terms and conditions contained in this solicitation, the contractor shall state "The terms and conditions in the solicitation are acceptable to be included in the award document with the exception, deletion, or addition of the following:" [Contractor shall list exception(s) and rationale for the exception(s)]. It is the sole responsibility of the Contractor to identify in their quote any exceptions to the terms and conditions of the solicitation. If the contractor does not include such a statement, the submission of a quotation in response to this solicitation will be regarded as the Contractor's acceptance of the Government's terms and conditions for inclusion into the resultant purchase order. c. The DUNS # for the Contractor's active System for Award Management (SAM) registration. Contractors must have an active registration at www.SAM.gov to be considered for award; d. If the Contractor's representations and certifications do not reflect the NAICS code governing this solicitation, Contractors must submit documentation that they are a small business under the NAICS code governing this solicitation. DUE DATE FOR QUOTATIONS E-mail quotations are required. All quotations must be submitted via e-mail to Tish Walker, Contract Specialist at latish.walker@nist.gov FAX quotations will not be accepted. Submission must be received not later than 5:00 p.m. Eastern Time on Friday, July 7, 2017. A quotation shall be considered received when it is received in the electronic inbox of Tish Walker not later than the date and time identified herein. All questions regarding this notice must be submitted via e-mail to latish.walker@nist.gov by 12:00 p.m. Eastern Time on Friday, June 30, 2017. Questions submitted after this date may not be addressed by the Government prior to the quotation submission deadline. PAYMENT The Contractor may invoice the Government upon notification from the Technical Point of Contact (TPOC) that a given deliverable is of acceptable quality; however, the contractor shall not submit in total more than ten (10) invoices.
