SS Justification HHSNIHOPC17-012086 THIS IS A NOTICE OF INTENT TO AWARD A SOLE SOURCE CONTRACT AND IS NOT A REQUEST FOR COMPETITIVE PROPOSALS UNDER THE AUTHORITY OF FAR 6.302-1. THE GOVERNMENT INTENDS TO SOLICIT A QUOTE AND ENTER INTO A CONTRACT WITH OLYMPUS AMERICA INC., OLYMPUS AMERICA INC., IS A SMALL BUSINESS UNDER THE NAICS 334510 IS THE ONLY SOLE PROVIDER OF EVIS/EXERA SLIM HYBRID BRONCHOSCOPES APPROVED THROUGH CERC COMMITTEE, DUE TO THE PROPRIETARY NATURE OF THIS REQUIREMENT, OLYMPUS AMERICA ARE EXCLUSIVELY USED BECAUSE THEY INTERFACE WITH OLYMPUS TECHNOLOGY THAT ARE CURRENTLY ON BRONCHOSCOPY CART, THIS EQUIPMENT HAS BEEN TESTED FOR ALL ANCILLARY SYSTEM USED IN THE PERFORMANCE OF BRONCHOSCOPY PROCEDURES UTILIZING THE OLYMPUS TECHNOLOGY. THIS IS THE REPLACEMENT OF THE OUTDATED AND NO LONGER SUPPORTED BY MANUFACTURER. ADDITIONALLY, CRITICAL CARE MEDICINE DEPARTMENT (CCMD), STAFF ARE ALREADY HAVE BEEN TRAINED IN THE USE AND CARE OF OLYMPUS BRONCHOSCOPE, SINCE, OLYMPUS OF AMERICA INC. HAS AN EXISTING SERVICE AND THE POTENTIAL COST TO THE GOVERNMENT FOR DISRUPTION OF OPERATIONS EXCEEDS ANY POSSIBLE COST BENEFITS THAT MAY BE AVAILABLE THROUGH A NEW ORDER. THEREFORE, IT IS IN THE BEST INTEREST OF THE CCMD MISSION TO MAINTAIN A CONSISTENT, HIGH QUALITY AND COST EFFECTIVE CLINICAL SERVICE TO FACILITATE THE RESEARCH GOAL FOR NIH MISSION. THE NOTICE OF INTENT WAS POSTED ON 06/26/2017 STATING THE INTENTIONS OF AWARDING THIS PROJECT SOLE SOURCE ENCOURAGING AND INCREASE COMPETITION AMONG SMALL BUSINESS TO APPLY IF DEEMED CAPABLE. BASED ON THE ABOVE, I RECOMMEND THIS ACQUISITION IS AWARDED TO OLYMPUS AMERICA INC., USING THE PROCEDURES IN FAR 6.302-1 TO SATISFY GOVERNMENT NEEDS.THE CONTRACTOR'S PRICE HAS BEEN ALREADY ESTABLISHED AND CONSIDER FAIR AND REASONABLE, FUNDS ARE CURRENTLY AVAILABLE. Olympus America Inc is the only known vendor that can performs support agreement for the repair and maintenance of damaged bronchoscopes at the Clinical Center, Critical Care Medicine Department. Since, Olympus of America Inc. has an existing service and the potential cost to the Government for disruption of operations exceeds any possible cost benefits that may be available through a new order. Department of the Critical Care Medicine has a continuing need for this service available under this order, Therefore, it has been determined that no other vendor who is capable to performs for this service other than Olympus America Inc., The Government shall consider all responses received prior to the close date of this announcement. Written responses to this notice shall contain sufficient documentation to establish bonafide capability to fulfill the requirement. All responses must be received no later than July 10, 2017, 12:00PM, EST. The resultant contract will be for delivery within 30 days after contract award. WRITTEN RESPONSES TO THIS NOTICE SHALL CONTAIN SUFFICIENT DOCUMENTATION TO ESTABLISH BONAFIDE CAPABILITY TO FULFILL THE REQUIREMENT. ALL RESPONSES MUST BE RECEIVED NO LATER THAN JULY 10, 2017 12:00PM, EST. THE RESULTANT CONTRACT WILL BE FOR DELIVERY WITHIN 30 DAYS FROM DATE OF AWARD ON OR BEFORE AUGUST 5, 2017.
