- Whitney M. Young Job Corps Center is requesting proposals from interested providers to submit their bids for Mental Health Coordinator. CENTER MENTAL HEALTH CONSULTANT (CMHC) WHITNEY M. YOUNG JOB CORPS CENTER STATEMENT OF WORK The Center Mental Health Consultant (CMHC), referred to henceforth as the Center Mental Health Consultant (CMHC), or Subcontractor, agree to provide students of the Whitney M. Young Job Corps Center, referred to henceforth as the center, with the services herein. Services will be provided as authorized by the Center Director or his/her representative. Payment for services rendered will be according to the agreed upon hourly rates for Center Mental Health Consultant: Minimum of twenty (20) hours per week, on average. Forty eight (48) weeks per year. The initial period of performance is from August 1, 2017 through July 31, 2018. Description of Work Subcontractor will agree to arrange for and/or provide students of the center with services stated herein. Such services will be provided as authorized by the Center Director or his/her representative, who will provide a schedule of hours and days to be worked weekly. Clinical services will be provided by center staff in emergency situations only. Subcontractor shall provide mental health services for students, including but not limited to: •1. Providing basic mental health care, as described by the Job Corps PRH. •2. Review and recommendations for applicant files that list mental health needs. •3. Short-term counseling with mental health checks as needed. The focus of which should be on retention and behaviors that represent employability barriers. •4. Providing written assessment and recommendations for all referred students. •5. Providing mental health promotion and education to both students and staff on center. •6. Providing treatment, crisis intervention and referral (both on and off center) for students as needed. •7. Providing or arranging 24-hour on-call and emergency coverage. May be provided by phone and/or in person. •8. Maintaining the accuracy and confidentiality of all required mental health and Wellness records when they are in the subcontractor's presence. •9. Reviewing and signing health care guidelines annually in accordance with the Technical Assistance Guide on health care guidelines. •10. Enforcing appropriate student workplace behavior when students are in the Wellness office or waiting area. •11. Arranging appropriate medical separations in conformity with the PRH. •12. Collecting data and preparing reports as required by the Center Director and/or the Department of Labor. •13. Advising/consulting as requested with the Center Director and center staff on mental health issues. •14. Cooperating with corporate and Regional Office center assessments. •15. Staying current on Job Corps policies and procedures by participating in monthly mental health conference calls and also attending webinars as provided by the regional health and wellness team for job corps •16. Conducting staff development and training in the use of mental health principles and techniques. •17. Arranging off center referrals and treatment (inpatient and outpatient) for students as needed, according to Job Corps health directives. TERMS AND CONDITIONS Independent Subcontractor : Under this agreement, the subcontractor is an independent contractor and not an employee or agent of Odle Management Group, LLC or the Department of Labor, Job Corps. As an independent subcontractor the center mental health consultant acknowledges that they would not be covered by Workers Compensation. Subcontractor agrees to provide professional insurance to cover subcontractor's professional services to students. Subcontractor agrees to indemnify and save the center harmless from any expenses, including attorney's fees and also claims on account of damage to property or bodily injury (including death) which may be sustained by himself/herself or his/her employees in connection with work performed. (Detailed insurance and indemnification requirements are below.) Termination : This agreement may be terminated, with respect to the remaining term of the agreement at any given time by either party upon written notice thereof to the other, effective thirty (30) days after acknowledged receipt of said notice. Public Statements : Subcontractor agrees to make no public statements concerning students or Job Corps activities without prior written approval of the Center Director or his/her designated representative. Research Projects and Publications : All research projects and/or publications relating to Job Corps health activities will first be cleared through the National Job Corps, Washington, D.C. Assignability : This contract may not be assigned by Subcontractor, but may be assigned by Odle Management Group, LLC. This contract sets forth the entire and only contract between Odle Management Group, LLC and Contractor. Any representation, promise or conditions, whether oral or written, not incorporated herein will not be binding upon either party. Conflict in Hours : Subcontractor agrees that he/she will not be entitled to and will not claim compensation for services performed under this contract for any hours of a working day for which he/she has received other compensation funds. For the purpose of this clause, payments by agencies or organizations funded by contracts or grants from the United States will constitute compensation for United States provided funds. It is further agreed by Contractor that any claim for compensation submitted in violation of this clause will, if paid, be recoverable from the contract. Privacy Act: •1. Subcontractor (the Provider) agrees: To comply with the Privacy Act of 1974 and the rules and regulations issued pursuant to the Act in design, development, or operation of any system of records on individuals in order to accomplish an agency function when the contract specifically identifies (I) the system or systems of records and (II) the work to be performed by the Provider in terms of anyone or combination of the following: design, development, or operation. To include the solicitation notification contained in this contract in every solicitation and resulting subcontract and in every subcontract award without a solicitation when the statement of work in the proposed subcontract requires the design, development, or operation of a system of records on individuals to accomplish an agency function; and To include this clause, including this paragraph (c), in all subcontracts awarded pursuant to this contract which requires the design, development, or operation of such a system of records. •2. In the event of violations of the Act, a civil action may be brought, against the agency involved where the violation concerns the design, development, or operation of a system of records on individuals to accomplish any agency function, and criminal penalties may; be imposed upon the officers or employees of the agency where the violation concerns the operations of a system of records on individuals to accomplish an agency function. For purposes of the Act when the contract is for the operations a system of records on individuals to accomplish an agency function, the contractor and any employee of the contractor is considered to be an employee of the agency. •3. The terms used in this clause have the following meanings: "Operation of a system of records" means performance of any of the activities associated with maintaining the system of records including the collection, use, and dissemination of records. "Record" means any item, collection, or grouping of information about an individual that is maintained by an agency, including, but not limited to, the individual's education, financial transaction, medical history, and criminal or employment history, and that contains the individual's name, or the identifying number, symbol, or other identifying particulars assigned to the individual such as a finger or voice print or a photograph. "System of records" on individuals means a group of any records under the control of any agency from which information is retrieved by the name of the individual or by some identifying number, symbol, or other identifying particular assigned to the individual. Indemnification : Subcontractor shall defend, indemnify and hold harmless Odle Management Group, LLC and its officers, directors, employees, agents, shareholders, partners, joint ventures, affiliates, successors and assigns from and against any and all liabilities, obligations, claims, demands, suits, losses, expenses, damages, fines, judgments, settlements and penalties, including, with limitation, costs, expenses and attorneys' fees incident thereto, arising out of or based up contract damages, property damage or bodily injury (including death at any time resulting therefrom) to any person, including subcontractor's employees, affiliates, or agents, occasioned by or in connection with (1) subcontractor's performance of (or failure to perform) the contract duties hereunder; (2) a violation of any laws or any negligent act or omission by subcontractor or its affiliates, subcontractors, agents or employees during the performance of the contract duties hereunder; or (3) a breach of this Agreement by subcontractor or any of its affiliates, subcontractors, agents, or employees. The aforesaid obligation of indemnity shall be construed so as to extend to all legal, defense and investigation costs, as well as all other reasonable costs, expenses and liabilities incurred by the party indemnified, from and after the time at which the party indemnified received notification (whether verbal or written) that a claim or demand is to be made. The subcontractor's obligation under this section does not extend to any liability caused by the sole negligence of Odle Management Group, LLC. Insurance : Subcontractor shall provide and maintain and cause its subcontractors to provide and maintain the following insurance coverage until obligations under this contract are satisfied: •1. Professional Liability insurance with a minimum combined single limit of $1 million for each occurrence and an aggregate of $3 million. •2. Where appropriate, Comprehensive Business Automobile Liability insurance with a combined single limit of $1 million per occurrence and in the aggregate. Failure to procure and maintain the required insurance and provide proof thereof, in the form of an appropriately executed certificate of insurance prior to the effective date of this contract or within thirty (30) days following the commencement of a new policy period, shall constitute a material breach of contract. Such certificate shall contain provisions that coverage afforded under the policies shall not be canceled, terminated, or materially altered without at least thirty (30) days prior written notice to the other party. Subcontractor shall obtain the required insurance from a provider that is A- or better by A.M. Best or as acceptable by Odle Management Group, LLC. NOTE: For further consideration, vendors who are unable to meet any of the above insurance requirements should provide a detailed statement as to why they are unable to comply. Invoicing : The Subcontractor shall submit to Odle Management Group, LLC, on a bi-weekly basis, an invoice for services provided during the covered billing period. The invoice shall include, at a minimum: Breakdown of hours worked Date(s) services provided Hourly rate for individual services, extended unit price and total. Invoice number and date
