- Notice of Intent The Office of Acquisition and Agreement Management (OAAM), of the National Institute of Standards and Technology (NIST), on behalf of the NIST Laboratories, intends to negotiate on a sole-source basis with Applied Energy Systems, Inc., of Malvern, PA, under the authority of FAR Part 13.106-1(b), as implemented by the Federal Acquisition Regulation(FAR) Part 13 for the upgrade of an existing Fully Automated Ultra High Purity Triple Gas Delivery System with Safety Cabinet. The Acquisition Management Division (AMD) at the National Institute of Standards and Technology (NIST) intends to procure the required system under a Firm Fixed Price modification of the existing Purchase Order, SB1341-17-SU-0666. The atom based metrology laboratory in PML currently uses sub-atmospheric phosphine gas sources in the process of fabricating atomically precise electronic devices. As a necessary safety precaution, the gas cylinder is kept in an AES safety cabinet with a fully automated gas delivery system, configured to deliver low doses of phosphine gas to the room temperature scanning tunneling microscope (STM) that is used for device fabrication. A new low temperature STM was brought on-line and will also require phosphine dosing capabilities. The system was recently purchased through Applied Energy Systems, under the authority of FAR 13.106-1(b). The additional upgrades required under this modification is incorporating a second gas manifold and outlet, which is determined to be within the scope of the original requirements, as the original requirements document required that the system be fully upgradeable to be able to contain two additional gas cylinders of phosphine compatible gases without the need for reengineering, which includes automated purging, monitoring with additional sensors specific to the chosen gases, and appropriate scrubbers for each type of gas, and all other functionality of the original order. Only Applied Energy Systems is identified as the sole capable contractor with the capabilities and proprietary knowledge of their existing system, and 100 percent compatibility of the current system is able to provide the necessary upgrades. The North American Industry Classification System (NAICS) code for this acquisition 333249 with a size standard of 500 employees. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. No solicitation package will be issued. This notice of intent is not a request for competitive quotations. However, responses received by the date indicated on the posting will be considered by the Government.
