Description
The Naval Special Warfare (NSW) Command, Contracting Department, San Diego, CA. 92155 intends to award a sole source contract for a Portable Hydro Acoustic Information Link (HAIL) System to the Original Equipment Manufacturer (OEM) and sole distributor, L-3 Communications MariPro, Inc. HAIL is an underwater communication system that is currently installed on Special Operations Forces (SOF) vessels and Special Operations Platforms (SOP). The systems are in multiple configurations so as to be compatible with specific applications and installations. The HAIL Software represents many years and thousands of hours of engineering effort. This intellectual property is the core of the Hydro-Acoustic Information Link system. The system is continually improved upon with updates to the source codes to include all basic algorithms and user interfaces. The software updates are provided to all customers on a periodic and as needed basis. L3 MariPro will not sell the data rights or the source code. Even if the Government owned the software rights, it would still need to contract with L3 MariPro for their unique technical expertise in HAIL support and installation. Costs associated with the development and installation of a new system, with the same capabilities as HAIL, would exceed tens of millions of dollars in developmental, interoperability testing, sustainment, training, and other programmatic costs. Market research revealed similar communications technologies are available; however, these technologies would not be compatible with the existing MariPro HAIL systems previously delivered to the SOF community. Since the SOF community is using the MariPro HAIL technology across all platforms, L3 MariPro is the only viable source. The sole source portable HAIL system will be acquired in accordance with the Federal Acquisition Regulation (FAR) Part 12 – Acquisition of Commercial Items and FAR Subpart 13 – Simplified Acquisition Procedures. The North American Industry Classification System (NAICS) code for this acquisition is 334310. The size standard is 750 employees.
