- NOTICE OF INTENT TO AWARD A SOLE-SOURCE CONTRACT The US Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), Eastern Region Acquisition Division, Simplified Acquisition Branch intends to negotiate on a sole source basis with Sutron Corporation, 22400 Davis Drive, Sterling, VA 20164, using the procedures in FAR Part 13, to provide Satlink Logger Transmitters, antennas, and cable assemblies. The National Weather Service uses Sutron Fischer Porter Rebuild-Digital (FPR-D) coop equipment in the field. The equipment is necessary to ensure fully operational systems are available 24x7x365. The system allows the National Weather Service (NWS), to accomplish its mission to protect life and property by providing essential environmental observations used by NWS warning systems, environmental models, short term forecasts, climate record, and feed several NWS products. Sutron is the original equipment manufacturer and provides the only equipment compatible with the existing units. Sutron maintains proprietary rights to all of their equipment. They possess the technical knowledge and patents covering the intricate designs of their equipment and any accessory items associated with that instrument. Sutron is the exclusive seller of equipment and repair parts and the only authorized repair facility for maintenance and repair of Sutron equipment. They have the specialized tools and proprietary knowledge needed to correctly repair and re-calibrate the equipment. Sutron covers all of their equipment with a standard manufacturer's warranty (1 year). Use of any other repair facility would void the warranty if any remained. This would also compromise future equipment repair and calibration, and adversely affect the quality of the data collected with the equipment. We request to sole source this requirement to Sutron Corporation as they are the only know source and no other supplies or services will satisfy agency requirements. The statutory authority for other than full and open competition is FAR 13.106-1(b)(1)(i), Only one responsible source. The North American Industry Classification Code (NAICS) for this acquisition is 334513 with a business size standard of 750. This is not a solicitation for competitive quotes. However, if any other interested party believes that it can meet the requirements, it may submit a statement of capabilities, which if timely received, will be considered by NOAA. A statement of capabilities must be received by 11:00am, August 7, 2017. A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future. Evidence must be provided of ability to provide the required services. The capability statement and any other information furnished must be in writing and must contain material in sufficient detail to allow NOAA to determine if the party can meet all of the requirements.
