- This is a NOTICE OF INTENT TO AWARD A SOLE SOURCE PURCHASE ORDER under the authority of FAR 13.5, Simplified Procedures for Certain Commercial Items. U.S. Customs and Border Protection (CBP) intends to solicit and negotiate directly with International Business Machines (IBM), 800 N. Frederick Ave., Gaithersburg, MD 20879 to provide one year renewal of software maintenance for WebSphere Portal Server 6.1 software currently in use at CBP. WebSphere Portal Server 6.1 is a proprietary Original Equipment Manufacturer (OEM) software that supports specific hardware and software products. WebSphere Portal Server 6.1 software items are CBP Technical Reference Model (TRM) approved items specifically tested and certified to meet CBP architecture requirements. The software is directly linked to the continued functioning of many U.S. Customs and Border Protection mission critical applications previously purchased for Mission Critical Systems software and tools. Support for these specific versions can only be procured from IBM direct. The IBM direct restriction only applies to those versions that have reached end of service and are no longer supported through IBM's standard offerings. IBM ended standard WebSphere Portal Server 6.1 support on September 30, 2014, but has agreed to provide continued WebSphere Portal Server 6.1 maintenance to CBP. No formal solicitation package will be issued. This notice of intent is not a request for competitive proposals. However, all responsible sources may submit a capability statement which will be considered by the agency. Any such documentation must be received by 4:00 pm Eastern Standard Time on August 16, 2017. All documentation must be submitted via email. The Government will not be responsible for any costs incurred in the preparation of responses to this announcement. All capability statements received by the due date of this notice will be considered by the Government. A request for documentation or additional information or submissions that only ask questions will not be considered as an affirmative response. The determination not to compete this proposed order based upon responses to this notice is solely within the discretion of the Government.
