The material or service listed in par. 3 below is sole source, therefore, consideration of the number of contractors required by FAR Subpart 8.4 Federal Supply Schedules, is precluded for the reasons indicated below. Restricted to the following source: Provide original manufacturer s name for material or contractor s name for service. (1) AGENCY AND CONTRACTING ACTIVITY: Department of Veterans Affairs Ann Arbor Healthcare System 2215 Fuller Road Ann Arbor, MI 48105 VISN: 10 (2) NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED: Purchase of new complete sleep study monitoring system for six (6) rooms/beds/patients at a time. 6 each Polysmith 10, PSG-1100 Sleep Acquisition Units with associated video camera system; 2 each 24 inch Monitors with Speaker Bar per Sleep Acquisition Unit, with 2 each Main Stream etCO2 Smart Cables with Disposables, 10 each Concurrent Drs. Stage/Score/Review/Dictate Scan License, Advanced Database with Advanced Clinical Search and Electronic Questionnaire, 20 Custom Report Pages, ELITE Remote Support for 6 each Acquisition Units and 1 each Server, with PSG 1100 Amplifiers with SCAN Concurrent Software that allows for 10 physicians to review at same time, HL 7 Sleep Interface Software Engine for Hospital Information System Interface, Sleep Accessories for 6 Beds, startup Sleep Disposables, Training, Materials, and Travel for one (1) Biomed Technician Course, Training, Materials, and Travel for one (1) Polysmith 10 Advanced Database and Sleep Report Building Course. (a) A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY S NEED: A complete sleep monitoring system for six (6) patients at a time to include built in etCO2, full EEG montage and Pes capabilities with HL-7, video camera system, dual monitors, stage/dictate/scan/review license for 10 providers at any given time, customizable reports including administrative QA reports, Biomed technical support training and Report building training. (b) ESTIMATED DOLLAR VALUE: $225,538.13 (c) REQUIRED DELIVERY DATE: October 1, 2017 (4) IDENTIFICATION OF THE JUSTIFICATION RATIONALE (SEE FAR 8.405-6), AND IF APPLICABLE, A DEMONSTRATION OF THE PROPOSED CONTRACTOR S UNIQUE QUALIFICATIONS TO PROVIDE THE REQUIRED SUPPLY OR SERVICE. (CHECK ALL THAT APPLY AND COMPLETE) Specific characteristics of the material or service that limit the availability to a sole source (unique features, function of the item, etc.). Describe in detail why only this suggested source can furnish the requirements to the exclusion of other sources. We found only the Nihon Kohden PSG-1100 Sleep Acquisition System has built in etCO2 which makes the Sleep Studies easier for the Sleep Technicians and the patients. It is also the only system we found with an all-in-one unit that is wall mountable which allows more space for the other equipment on the night stand. All the other systems require the additional purchase of the separate etCO2 equipment that is compatible with that system. The Nihon Kohden PSG-1100 Sleep Acquisition System also has Pes capability which some but not all other systems have. The Nihon Kohden also has the best administrative report queries of all the systems we looked at, particularly the QA reports which is very beneficial to the Ann Arbor VAMC Sleep Lab due to the current wait list and patient access issues. A patent, copyright or proprietary data limits competition. The proprietary data is: (If FAR 8.405-6(a)(2) iii before posting. Do not include specific proprietary data. Only mention the type of equipment, procedure, etc. to show that proprietary supplies or services are being procured.) These are direct replacements parts/components for existing equipment. ____________________________________________________________________________ ____________________________________________________________________________ The material/service must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing. Describe the equipment/function you have now and how the new item/service must coordinate, connect, or interface with the existing system. The new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order must not have been previously issued under sole source or limited source procedures. An urgent and compelling need exists, and following the ordering procedures would result in unacceptable delays. (5) DESCRIBE WHY YOU BELIEVE THE ORDER REPRESENTS THE BEST VALUE CONSISTENT WITH FAR 8.4 TO AID THE CONTRACTING OFFICER IN MAKING THIS BEST VALUE DETERMINATION: The Compumedics system appears to cost less. However, when you add the recurring costs ($12,000/yr. min. based on current workload) and the cost of the additional equipment that would have to be purchased to meet the clinical requirements such as the etCO2, it costs more than the Nihon Kohden system. The Natus XLTek system does not meet our clinical requirements (not Pes capable, bulkiest headbox with another VA reporting rusting of the headbox within less than 2 years requiring replacement, limited customizability of database and reports) and is not user friendly. (6) DESCRIBE THE MARKET RESEARCH CONDUCTED AMONG SCHEDULE HOLDERS AND THE RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT CONDUCTED: We searched and contacted Sleep Monitoring System vendors on FSS/GSA contract and we contacted other vendors on the VA approved list including Compumedics/Electramed and Natus XLTek. We invited the vendors to provide demos of their equipment and its capabilities, toured other sleep labs, contacted other VA facilities with sleep study labs and visited local hospitals with sleep labs to find out what equipment they have and any issues they have with it, their likes and dislikes. We obtained price quotes from Compumedics and XLTek as well as Nihon Kohden. (7) ANY OTHER FACTS SUPPORTING THE JUSTIFICATION: We currently have an Electramed Compumedics system and are very unhappy with the poor customer service and technical support. The HL7 which we purchased has been nonfunctional for the 7 years we have had it despite the vendor promises and attempts to make it functional, most recently citing a VA Microsoft upgrade for the reason it does not work. Every time there is an update there are additional problems that need to be fixed that don t get addressed in a timely manner requiring work-arounds by clinical staff which at times impacts patient care. Compumedics requires 24/7 VPN access to the Nexus 360 server for upgrade. Nihon Kohden meets the VA OI&T/ISO computer security requirements. We don t know that the other two vendors do and we have concerns that the Compumedics system will not work correctly with the ongoing VA computer security requirements based on our experience. (8) A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS THAT LED TO THE RESTRICTED CONSIDERATION BEFORE ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES IS MADE: There are no barriers to competition, however, this is the equipment that best meets the needs according to extensive market research. (9) REQUIREMENTS CERTIFICATION: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge.
