7AR2160/USAO/Little Rock, AR Justification For Other Than Full And Open Competition PAGE 1 OF 3 Last Revised 2/26/14 U.S. General Services Administration GSA Region 7 Leasing Division Justification for Other than Full and Open Competition Lease Number: GS-07B-15604 Project Number: 7AR2160 Agency Name: US Attorneys (USAO) 1. Identification and Description of Action Being Approved: The General Services Administration currently leases rentable square feet (RSF) of office space at 425 W Capitol Ave in Little Rock, AR under lease number GS-07B-15604 for the USAO. The current lease expired 3/31/17. Approval is requested to execute a five-year lease extension with the incumbent landlord without full and open competition for continued occupancy at this leased location. It is recommended that GSA exercise this extension while continuing to work with the agency on developing requirements for a long term lease. 2. Description of Supplies or Services Required: The existing lease consists of 31,728 ABOA SF/ RSF of space in Little Rock, AR. The agency confirmed that the office space supports their requirements and is capable of meeting their needs for another five years. The rate contained within the extension provides an estimated contract value as follows: 3. Identification of Statutory Authority: 41 U.S.C. 253(c) (1): Only one responsible source and no other supplies or services will satisfy agency requirements 4. Demonstration that the Acquisition Requires use of the Authority Cited: In accordance with 41.USC.253 (c) (1), only one responsible source and no other supplies or services will satisfy agency requirements. GSAM 570.402-4 allows for negotiation with the incumbent lessor when no potential acceptable locations are identified through the advertisement or the market survey. Since a search of the delineated area using Costar returned no properties with sufficient contiguous space available to satisfy the agency's minimum square footage requirements, it was determined the incumbent lessor was the only responsible vendor that could meet the Lease requirement. 5. Description of Efforts to Solicit as Many Offers as Practical: On January 30, 2017, GSA conducted market research within the Little Rock CBD area using Bullseye market data (REIS, CoStar, & CBRE). In addition, an advertisement was placed in FedBizOpps on January 31, 2017. GSA received one expression of interest, from the incumbent lessor, which is: Incumbent: 425 W Capitol Ave 7AR2160/USAO/Little Rock, AR Justification For Other Than Full And Open Competition PAGE 2 OF 3 Last Revised 2/26/14 6. Demonstration that the Anticipated Cost will be Fair and Reasonable: GSA is currently paying per RSF, fully serviced for RSF at 425 W Capitol Ave in Little Rock, AR. The estimated square footage to be acquired under the lease extension is RSF (31,728 ABOA). On January 30, 2017, a Bullseye report provided market research within the Little Rock CBD Submarket area using CoStar, REIS, and CBRE data. According to Bullseye market data, the target rate is per RSF. If GSA executes a 5 year lease extension, the anticipated rate will not exceed 10% above the Bullseye target, or per RSF. 7. Description of the Market Survey Conducted: Bullseye report provided market research within the Little Rock CBD Submarket area using CoStar, REIS, and CBRE data. Market Data for the Area 8. Other Facts Supporting the use of Other Than Full and Open Competition: The current Lessor is responsive and is meeting the requirements of the lease. The current leased location meets the agency's requirements. 9. List of Sources that Expressed an Interest in the Acquisition: There have been no written expressions of interest for this extension. 10.
