- Philips Patient Monitoring Components Control Number TAC-17-44097 2 of 5 Control Number TAC-17-44097 LIMITED-SOURCES JUSTIFICATION 1. Contracting Activity: Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, NJ 07724 2. Description of Action: This proposed action is for a competitive firm-fixed price delivery order issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V Governmentwide Acquisition Contract (GWAC) for brand name Philips IntelliVue hardware and software with installation, configuration and training. 3. Description of the Supplies or Services: The Louis Stokes Cleveland VAMC is undergoing a complete upgrade and expansion from its current Philips IntelliVue Information Center (PIIC) classic platform to the Philips iXB platform. This action is to procure brand name Philips MX patient monitors and associated components as well as network expansion software in support of this upgrade. The Contractor shall replace all of the existing Philips MP series patient monitors and associated modules at the Louis Stokes VAMC with the Philips MX series monitors and associated modules, and shall install wireless expansion software and associated components to support expanded Telemetry coverage throughout the medical center. This effort shall include installation, configuration, testing and network verification, as well as on-site staff training. All components shall be installed no later than 180 days after award. The total estimated value of the proposed action is $. 4. Statutory Authority: The statutory authority permitting this exception to fair opportunity is 41 U.S.C. 4106(c)(2) as implemented by Federal Acquisition Regulation (FAR) 16.505(b)(2)(i)(B), entitled Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized. 5. Rationale Supporting Use of Authority Cited Above: This procurement is part of an ongoing upgrade to the Philips patient monitoring platform currently in use at the Louis Stokes VAMC. Currently, all areas of the medical center that require physiological patient monitoring are connected to the Philips network infrastructure that is comprised of servers, computers, displays, monitors, switches, routers, cabling, wireless access points and Philips proprietary Food and Drug Administration (FDA) approved software which act as a complete monitoring system to provide clinical staff with real time physiological patient data to more effectively treat critically ill patients. This effort is to replace the existing Philips MP series patient monitors and associated modules with new Philips MX patient monitors and associated components, and to expand the existing Philips domain infrastructure to ensure telemetry coverage and connectivity throughout the medical center. Philips Medical Systems Inc. holds proprietary rights to software, upgrades and component equipment to be used with its telemetry and critical care patient monitoring platform. Only Philips brand bedside monitors and network expansion software can be integrated into the existing platform. No other brand components are compatible or interoperable with the existing platform due to these proprietary constraints. Further, the installation and configuration of these components can only be completed by Philips Medical Systems, Inc. or their distributors due to the proprietary nature, and the need to maintain the integrity, safety, and accuracy of the systems in accordance with manufacturer specifications. The systems provide direct patient care and cannot be compromised. Introducing any other brand name infrastructure components will jeopardize VHA s ability to effectively upgrade the existing platform to a new, more efficient monitoring system thereby signifcantly impacting critcal patient care at the Louis Stokes VAMC. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. This effort did not yield any additional sources, other than the Original Equipment Manufacturer (OEM) and authorized resellers, that can meet the Government s requirements. It was determined, however, that limited competition is available among authorized resellers of Philips brand name products that hold current NASA SEWP V GWACs. In accordance with FAR 5.301 and 8.405-6(a)(2), this action will be synopsized at award on the Federal Business Opportunities Page (FBO) and the justification will be made publicly available. 7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future actions to be competed. 8. Market Research: The Government s technical experts conducted market research starting in 2016 and up to March of 2017 when the acquisition process was initialized. The market research consisted of researching other similar patient monitoring system components available from the top comparable brands such as General Electric and Space Labs. The market research confirmed that no other brand patient monitors and expansion software can be integrated into the existing infrastructure at the Louis Stokes VAMC due to the proprietary constraints discussed in Pargraph 5 above. No other patient monitoring hardware or software components were found to be interoperable or compatible with the existing Philips patient monitoring and network infrastructure currently in place at the VAMC. Further, only Philips or its authorized resellers can access the existing infrastructure in order to install, configure and verify the upgraded components and expansion software to maintain the integrity, safety, and accuracy of the overal patient monitoring system in accordance with manufacturer specifications. Additional market research was conducted in May 2017 by the Contract Specialist by utilizing the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V Governmentwide Acquisition Contract (GWAC) Provider Lookup tool that identified 7 prospective, Vendor Information Pages (VIP) verified Service-Disabled Veteran-Owned Small Business (SDVOSB) GWAC holders in Group B(2) that are resellers of Philips products and services. Additionally, NASA SEWP V has a dynamic product catalog where line items can be added based on customer requests; therefore, as long as the required item or service is within scope of the NASA SEWP V GWAC, items and services can be added to a NASA SEWP V GWAC holder s catalog on a daily basis. Futher market research was conducted via a Request for Information (RFI) issued on May 24, 2017 on NASA SEWP V as well as on the General Services Administration (GSA) Medical Equipment and Supplies Schedule 65 II A. The RFI yielded one response from a verified SDVOSB on NASA SEWP, and two responses from verified SDVOSBs on GSA. The responses were sent to a technical representative from the Louis Stokes VAMC who determined that all the respondents appeared capable as they would be passing through the work to the Original Equipment Manufacturer. Considering only one response was received from a NASA SEWP GWAC holder, and the Provider Lookup Tool revealed multiple resellers, the Contracting Officer contacted a respresentative from Philips to determine if there were in fact multiple SDVOSB resellers on NASA SEWP that were capable of providing the particular products and services associated with this effort. The representative confirmed that although only one SDVOSB NASA SEWP contract holder responded to the RFI, Philips had been in recent communication with other potential SDVOSB resellers on NASA SEWP regarding the resale of it products and services, and as a result of those commuications, anticipated increased participation among multiple SDVOSB resellers. As a result, limited competition is expected among verified SDVOSB resellers in NASA SEWP Group B(2). The Philips represenative also indicated that one of the two GSA RFI respondents was not a capable reseller of the particular Philips products and services required under this acquisition. Further, it was revealed that serveral of the Philips components were not included on the resellers GSA catalog, and would therefore have to be treated as open market items. 9. Other Facts: None.
