Description
The Bureau of Reclamaton intends to negotiate with Bear Creek Consulting LLC as a Construction Subject Matter Expert (SME) on a sole-source basis. The SME is needed to assist the Govenrment in the evaluation of potential constructive changes and/or claims. The SME is needed to analyze the government contract and contractor's interpretation of the contract to offer an independent opinion regarding the validity of opposing views. The SME will utilize the following in the preparation of the opinion:A. Collect and review all government-furnished materials. Review the drawings and specifications and evaluate the contract requirements with specific emphasis on - i. The borrow sites made available to the contractor ii. The borrow materials that could have reasonably been expected in the borrow areas selected by the contractor. iii. The processing that would be necessary in the borrow areas selected. iv. All Required Submittals (RSNs) concerning the borrow areas. B. Collect and review contractor furnished materials with specific emphasis on - i. the timing of the borrow submittals and the Government responses as well as the content of the submittals and the content of the Government responses ii. Review the contractor's baseline schedule and all monthly updates iii. Review the correspondence related to the alleged Constructive Changes. C. Evaluate the contractor's performance, particularly in regard to the work restrictions and site requirements. D. Evaluate the contractor's claim of a "Constructive Change" for the embankment material. E. Consult with the Contracting Officer (CO) and other Reclamation staff for collecting, organizing, identifying, or providing data (and sufficient documentation for moving forward) to clarify and/or support Reclamation's position. F. Attend meetings as necessary to discuss findings. Meeting attendance may be in person or video/teleconference. The Project Manager (PM) will determine if a site visit is needed. G. Consult with the CO regarding the current status, strength, or weakness of the government's position, discuss the possibility of negotiation, mediation, or court action, and make recommendations to the CO on the best course of action moving forward with the contract. H. Prepare for and attend a meeting (in person or video/teleconference) scheduled by the PM for finalizing work before developing and writing a final report. The final report shall state the positions of the government and the Construction Contractor, outlining strengths and weaknesses of those positions with respect to the contract and the FAR, and provide recommendations to the CO. The SME will provide a draft outline of the report with sufficient detail to facilitate a discussion of the above prior to the final report. I. Draft Report/Agenda for the Review Meeting: Outline of the final report with sufficient detail to facilitate discussion of the final report. J. Final report: The final report shall state the positions of the government and the Construction Contractor, outlining strengths and weaknesses of those positions with respect to the contract and the FAR. The final report shall provide the SME's recommendations to the CO. The SME must demonstrate extensive experience in construction management, schedule analysis, and claims analysis applying extensive knowledge of the FAR, and Federal construction contracts. The SME must have relevant experience that demonstrates understanding of the interconnection between schedule analysis and claims analysis to determine the net effect of both on the construction project. Bear Creek Consulting, LLC is owned/operated by an individaul with a professional civil engineer with unique and proven performance to establish subject matter expertise in both claims analysis and schedule analysis. They are known to have an extensive knowledge of Federal contract law, change orders, and construction claims as it applies to construction law. They are available on short notice and is flexible about accommodating the potentially erratic mediation schedule this project may present. The Government's requirements cannot be met by another source because of the time requirements to train another individual on the specifics of the requirements. Possession of the skills required (both claims analysis and schedule analysis) are not available
