- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition (>$150K) Acquisition Plan Action ID: VA246-17-AP-13458 Contracting Activity: Department of Veterans Affairs, Network Contracting Office 6 (NCO 6), on behalf of the VA Medical Center (VAMC) in Fayetteville, North Carolina, has a requirement for the acquisition of Brand Name portable sleep monitoring machines under purchase request number 565-17-4-2000-0047. Nature and/or Description of the Action Being Processed: The objective for this request is to procure Brand Name product of Carefusion 211. The equipment request is for Portable Sleep Monitoring Machines (NOX T3 Complete Kits), to be procured by means Other Than Full and Open Competition, with delivery to the VA Medical Center, 2300 Ramsey Street, Fayetteville, North Carolina 28301. A new contract, firm fixed-priced, is planned for this one-time equipment procurement. This procurement is conducted in accordance with FAR Subpart 13.5 Simplified Procedures for Certain Commercial Items and, specifically, FAR Subpart 13.501 Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2. Description of Supplies/Services Required to Meet the Agency s Needs: The purchase request submitted to NCO 6 is in support of procuring the following Brand Name equipment: Quantity of Fifty (50), Carefusion 211 brand of portable sleep monitoring machines (NOX T3 Complete Kits), and associated disposables, with estimated total value of $; delivery to the Fayetteville VAMC. This procurement will be awarded to Trillamed LLC, a VetBiz-Certified Service-Disabled Veteran-Owned Small Business (SDVOSB). Statutory Authority Permitting Other than Full and Open Competition (x) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; The authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. 1901 and is implemented by for restricting competition on this procurement via FAR 13.106-1(b)(2). Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The Fayetteville VAMC Medical Service has procured other Carefusion 211 brand of sleep study monitoring equipment and has standardized to this brand based on quality and compatibility with existing equipment. Noted here are the most recent procurements for the Fayetteville VAMC: a) Contract number VA246-17-P-1725, awarded on December 23, 2016 for Carefusion 211 Brand portable Sleep Monitors; b) Contract number VA246-16-F-7389, awarded on August 29, 2016 for a Carefusion 211 brand SomnoStar Z4 VER10 Sleep System and accessories; and c) Contract number VA246-16-F-7296, awarded on August 24, 2016 for Carefusion 211 brand QCD Pro Kits used in sleep apnea testing and treatment. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Seemingly, with the two sources stated below in paragraph 8, a competitive acquisition would be in order, most likely as an unrestricted competition. However, this strategy is not recommended as the SDVOSB concern would be competing against its own manufacturer, as their business relationship is tied by a distribution agreement. As such, it is recommended that Trillamed LLC receive a sole sourced award pursuant to 38 USC § 8127(c). Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Trillamed LLC is determined to be a responsible source with respect to contract performance and can provide the required equipment at a fair and reasonable price as evidenced by equipment contracts executed on behalf of several VISNS within the past year (source - Federal Procurement Data System). Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research, in accordance with FAR Part 10, was conducted by internet searches, FPDS and FBO searches which determined that the OEM (Carefusion 211) and TrillaMed LLC (SDVOSB) are the two sources available for the brand name product required for this acquisition. Market research indicates other companies can provide sleep monitoring systems; however, the Fayetteville VAMC Medical Service has standardized this specialized Sleep Study instrumentation to the Carefusion 211 brand based on quality and compatibility with existing equipment. Other known brands of instrumentation are not suitable as they do not enable the downloading of patient diagnostic results directly to the stand alone compatible equipment. Any Other Facts Supporting the Use of Other than Full and Open Competition: There are no additional facts in support of this request other than those previously stated. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: No Sources Sought Notice was published due to the need for Brand Name equipment and a known SDVOSB source has available resources to meet the requirement. As such, no parties have expressed interest in writing. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: A national equipment contract, executed by NAC, may serve to foster competition for future procurements; however, there are no actions which can be presently taken to overcome barriers to competition.
